A RESOLUTION OF THE CITY OF DENTON ADOPTING POLICY NO. 107.05 "QUARANTINE LEAVE" OF THE CITY OF DENTON PERSONNEL POLICIES AND PROCEDURES; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the new Quarantine Leave policy (no. 107.05) was created based on the passage of state legislation HB 2073 that requires the City of Denton to develop and implement a paid quarantine leave policy for firefighters, peace officers, detention officers, and emergency medical technicians who are employed or appointed by the City of Denton and ordered to quarantine or isolate due to a possible or known exposure to a communicable disease while on duty; and WHEREAS, the City of Denton City Council deems it in the public's best interest to adopt the new Quarantine Leave policy (no. 107.05); NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The Policy Statement in "Policy No. 107.05 Quarantine Leave", which is incorporated in this section, is hereby adopted as an official policy of the City of Denton: POLICY STATEMENT: In compliance with Section 180.008 of the Texas Local Government Code, this policy is adopted to provide paid quarantine leave for Firefighters, Peace Officers, and Detention Officers. The quarantine leave will be used to quarantine or isolate Firefighters, Peace Officers, and Detention Officers, due to a possible or known exposure to a communicable disease while on duty. The City of Denton ("City") recognizes that employee health and safety is important. The City supports establishing a workplace that is healthy, safe, and supportive. SECTION 2. This Resolution only adopts and approves the "Policy Statement" portion of the Quarantine Leave Policy included in No. 107.05 of the City of Denton Personnel Policies and Procedures Manual. The "Administrative Procedures" portion of the Quarantine Leave Policy is not a policy of the City Council, but rather, an administrative procedure describing the means and methods by which City management implements the Quarantine Leave Policy. The City Manager is authorized to amend and issue such administrative procedures and directives as deemed necessary to implement the Quarantine Leave Policy related to personnel and internal operational matters. SECTION 3. The attached policy shall be filed in the official records with the City Secretary. SECTION 4. This Resolution shall become effective immediately upon its passage and approval. SCOPE This policy applies to all Firefighters, Peace Officers, and Detention Officers employed by the City of Denton. Police and Fire Department management will be responsible for communicating and implementing this policy as applicable. U. DEFINITIONS "Detention officer" means an individual appointed or employed by the City of Denton whose job responsibilities include the care and custody of individuals incarcerated in the municipal jail. "Firefighter" means a paid employee of the City of Denton Fire Department who: (A) holds a position that requires substantial knowledge of firefighting; (B) has met the requirements for certification by the Texas Commission on Fire Protection under Chapter 419, Government Code; and (C) performs a function listed in Section 143.003(4)(A). "Health authority" has the meaning assigned by Section 121.021, Health and Safety Code. "Peace officer" means an individual described by Article 2.12, Code of Criminal Procedure, who is employed by the City of Denton. "Communicable disease" means an illness as described under Chapter 81, Section 81.003, Health and Safety Code that occurs through the transmission of an infectious agent or its toxic products from a reservoir to a susceptible host, either directly, as from an infected person or animal, or indirectly through an intermediate plant or animal host, a vector, or the inanimate environment. QUARANTINE LEAVE PROCEDURES The use of paid quarantine leave may be granted after a Firefighter, Peace Officer, or Detention Officer been ordered to quarantine or isolate due to a possible or known exposure to a communicable disease while on duty. The local county health authority will determine when a threat of highly communicable or life - endangering diseases are immediately present. When this occurs, department supervisors may order the use of paid quarantine leave due to a possible or known exposure to a communicable disease while on duty. Employees will be ordered to quarantine or released from quarantine leave based on their supervisor's approval. This Quarantine Leave Policy is administered concurrently with all other relevant City policies. Applicable employees on paid quarantine leave will continue to be eligible for all employment benefits and compensation, including continuing their leave accrual, pension benefits, and eligibility for health benefit plan benefits for the duration of the leave. While on paid quarantine leave, the employee will not use other paid leave types (e.g., vacation, sick, holiday leave). Quarantine leave is not considered "hours worked" for purposes of overtime and will be paid at the employee's straight time rate. If an employee who has been directed to quarantine has secondary employment, the employee must refrain from working their secondary job while under quarantine. The employee's approval for secondary employment shall automatically be temporarily suspended while the employee is on quarantine leave and shall be automatically reinstated once the employee is no longer required to quarantine. When applicable, employees who are ordered to be quarantined may be eligible for reimbursement for reasonable costs related to the quarantine, including lodging, medical, and transportation expenses. All reimbursements must be approved by the employee's Department Head or their Designee, and unreasonable reimbursements may be denied in consultation with the Director of Human Resources or their Designee. In order to be reimbursed, all expenses must be submitted on an expense report attached with receipts that substantiate the employee paid the expenses in which the employee is seeking reimbursement. Employees who are exposed to a communicable disease while on duty must also file a workplace injury/illness report with the City's Risk Management division. HIR/POLICY/107.05
