A RESOLUTION OF THE CITY OF DENTON PROVIDING FOR REMOVAL FOR CAUSE
OF A MEMBER OF THE HEALTH AND BUILDING STANDARDS COMMISSION, INACCORDANCE WITH ARTICLE XIV, SECTION 14.16 OF THE DENTON CITY CHARTER;PROVIDING NOTICE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Denton City Charter, Article XIV, Section 14.16, states, “ Members ofboards and commissions of the City of Denton shaH serve at the pleasure of the council.
Members of such boards and commissions may be removed by the council only for cause and
only after being given notice by the council. ’
WHEREAS, the Boards & Commissions Handbook details removal from office as follows:
"In the event a new member fails to submit the required appointment forms (oath of offIce,appointment of offIcer, and/or affIrmation of qualifIcations) within 14 days of notice of
appointment or make an appointment with the City Secretary 's offIce or complete the open
government training within the timeframe specifIed by the OffIce of the Attorney General, thatfailure shall constitute for-cause removal as outlined in City Charter, Article XIV, Section
14.16
WHEREAS, the Denton Boards & Commissions Handbook, last revised by Resolution 21-271 adopted on April 20, 2021, addresses notification be sent to any member who has failed to
meet board member attendance requirements.
WHEREAS, Cyndell Addison was appointed to the Health and Building Standards
Commission (Member) on December 14, 2021 and subsequently sent her post-appointment packet
on December 15, 2021. The Member failed to submit the necessary paperwork by the 14-daydeadline.
WHEREAS, the City Secretary, on January 20, 2022, sent written notice to the Member
on the failure to submit post-appointment paperwork and was afforded the opportunity to submit
the paperwork by Monday, January 31, 2022 or face possible removal. Additional contact efforts
to reach the Member were made on December 27, December 30, January 13, January 14, andJanuary 18, 2022, with no successful results.
WHEREAS, the Member failed to submit the post-appointment paperwork or contact the
City Secretary’s Office by the January 31, 2022 deadline. NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1. Health and Building Standards Commission Member Cyndell Addison is
hereby removed for cause for failing to submit the post-appointment paperwork as addressed inthe Boards & Commissions Handbook.
SECTION 2. This Resolution shall become effective immediately and the City Secretary
is hereby directed to send a copy of this resolution as notice via certified and regular mail to the
member within five days of the date of its passage.
