HomeMy WebLinkAbout22-406RESOLUTION NO.22-406 A RESOLUTION OF THE CITY OF DENTON REPEALING POLICIES NO. 1.00 – 7.00 OFTHE CITY OF DENTON PERSONNEL POLICIES AND PROCEDURES; ADOPTINGPOLICY NO. 1.00 “POLICIES, PROCEDURES, AND ADMINISTRATIVE DIRECTIVES”;AND DECLARING AN EFFECTIVE DATE. WHEREAS, the following City of Denton Policies No. 1.00 – 7.00 have existed since the 1990’s providing foundational policies for the City’s Policies and Procedures Manual: • • • • @ • • 1.00 Purpose of the Policies and Procedures Manual 2.00 Distribution of City Policies and Procedures and Administrative Directives 3.00 Method for Instituting a New or Revised Policy, Procedure or Directive 4.00 Method for Updating the Manual5.00 How to Use the Manual 6.00 Definitions of Terms Policy, Procedure and Administrative Directive 7.00 Applicability of Policies; and WHEREAS, the City wishes to consolidate these seven (7) outdated policies into one updated policy to comprehensively govern the policy process, including the development, review, adoption, implementation, and monitoring of policies; and WHEREAS, the City Manager recommends adoption of a revised policy and the CityCouncil desires to adopt such policy; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. This Resolution repeals Policies No. 1.00 – 7.00 of the City of DentonPolicies and Procedures Manual as titled and listed below: • • • • • • • 1.00 Purpose of the Policies and Procedures Manual 2.00 Distribution of City Policies and Procedures and Administrative Directives 3.00 Method for Instituting a New or Revised Policy, Procedure or Directive 4.00 Method for Updating the Manual5.00 How to Use the Manual 6.00 Definitions of Terms Policy, Procedure and Administrative Directive 7.00 Applicability of Policies SECTION 2. The Policy Statement in “Policy No. 1.00 Policies, Procedures, and Administrative Directives”, which is incorporated in this section, is hereby adopted as an official policy of the City of Denton: POLICY STATEMENT: The purpose of this Policy is to provide guidance for the development and implementation of Policies, Procedures, and Administrative Directives, as farther defined herein. City of Denton Policies reflect the City’s mission and vision and comply with federal and state laws. If there is a discrepancy between a Policy, Procedure, or Administrative Directive and the Code of Ordinances of the City of Denton, Texas, the Code of Ordinances shall take precedence. Section 2-28 of the Code of Ordinances addresses Policies, Procedures, and Directives. PerSection 2-28 : • Policies and any amendments thereto shall by reviewed by the City Attorney for legal compliance and approved by resolution of the City Council. • The City Manager is authorized to issue such administrative procedures and directives as deemed necessary to implement approved policies relating to personnel and internal operational matters. Policies, Procedures, and Administrative Directives are applicable to all hIll-time, part-time, temporary, and seasonal City employees unless otherwise specified. Vendors performing services on behalf of the City may also be subject to applicable City Policies, Procedures, andAdministrative Directives. The City of Denton is an “at wiIF’ employer and, as such, employment with the City of Denton is not for a fixed term or definite period and may be terminated at the will of either party, with or without cause, and without prior notice. The contents of the Policies, Procedures, and Administrative Directives do not in any way constitute the terms of a contract of employment and shall not be construed as a guarantee of continued employment with the City of Denton, nor a guarantee of any fixed terms and conditions of employment. Policies, Procedures, and Administrative Directives are continually evaluated and may be amended, modified, or terminated at any time as provided by Section 2-28 of the Code of Ordinances. SECTION 3. This Resolution only adopts and approves the “Policy Statement” portion of the Policies, Procedures, and Administrative Directives Policy included in No. 1.00 of the City of Denton Personnel Policies and Procedures Manual. The “Administrative Procedures” portion of the Policy is not a policy of the City Council, but rather, an administrative procedure describing the means and methods by which City management implements the Policies, Procedures, and Administrative Directives Policy. The City Manager is authorized to amend and issue such administrative procedures and directives as deemed necessary to implement the Policies, Procedures, and Administrative Directives Policy related to personnel and internal operational matters. SECTION 4. The attached policy shall be filed in the official records with the City Secretary. SECTION 5. This Resolution shall become effective immediately upon its passage and approval.
