A RESOLUTION OF THE CITY OF DENTON ADOPTING POLICY NO. 500.08 “TRESPASSWARNING ON CITY PROPERTY” OF THE CITY OF DENTON POLICIES ANDPROCEDURES; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Denton desires to create a reasonably ordered, peaceful, and safe environment on City property and inside City buildings; and WHEREAS, although very limited, there may be serious incidents on City property in which City staff may have to issue a criminal trespass warning when an individual has committed a violation of law, city ordinance, and/or city policies in order to ensure a safe environment for all and the continued provision of public services and spaces to individuals and families in the community; and WHEREAS, an interdepartmental team including Community Services, Police, Parks, and Library with the help of the Municipal Judge’s Office and Legal, identified creating a formalpolicy, specifically one that allows for an administrative appeal process, would be in the best interest of the City, the community at large, and those that are issued trespass warnings; and WHEREAS, this policy herein achieves these desired goals of ensuring a reasonably ordered, peaceful, and safe environment on City property while also providing additional due process and protections for those individuals that may be trespassed; and WHEREAS, the City of Denton City Council deems it in the public’s best interest to adopt the new Trespass Warning on City Property policy (no. 500.08); NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The Policy Statement in “Policy No. 500.08 Trespass Warning on City Property”, which is incorporated in this section, is hereby adopted as an official policy of the City of Denton: POLICY STATEMENT: The City of Denton (City) recognizes its duty to be a responsible steward of City assets. The City also desires to provide the public and City staff at City Property, buildings and facilities, to the extent permitted by law, an environment free from unlawful and disruptive behavior and activities that interfere with City and public business and activities. The City Council has authorized delegated authority to the City Manager and designees to act on its behalf as owner of City buildings and facilities to enact and enforce a trespass policy excluding criminal trespassers, trespassers, and any persons engaging in disruptive, illegal or harmful activities from City Property, buildings, and facilities. The City developed this policy: a. To create a uniform process for issuing notices to people whose entry onto City Property, or continued presence on City Property, may be illegal, unreasonably disruptive or harmful to City Property or to conducting City business, to other persons’ use or enjoyment of approved activities on City Property, or to the safety of staff or other persons; and b. To provide persons receiving a Trespass Warning with the opportunity for a promptadministrative review of the terms of the Trespass Warning. This policy shall be posted on the City's website and shall remain on file with the CitySecretary. SECTION 2. This Resolution only adopts and approves the “Policy Statement“ portion of the Trespass Warning on City Property Policy included in No. 500.08 of the City of Denton Policies and Procedures Manual. The “Administrative Procedures” portion of the Trespass Warning on City Property Policy is not a policy of the City Council, but rather, an administrative procedure describing the means and methods by which City management implements the Trespass Warning on City Property Policy. The City Manager is authorized to amend and issue such administrative procedures and directives as deemed necessary to implement the Trespass Warning on City Property Policy related to personnel and internal operational matters. SECTION 3. The attached policy shall be filed in the official records with the City Secretary. SECTION 4. This Resolution shall become effective immediately upon its passage and approval.
