HomeMy WebLinkAbout22-1592RESOLtrrioN NO. 22-1592 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS PLACnqGA PROPOSAL ON THE SEPTEMBER 27, 2022 CITY COUNCIL PUBLIC MEETINGAGENDA TO ADOPT A 2022 TAX RATE THAT WILL EXCEED THE LOWER OF THE NO-NEW-REVENUE TAX RATE OR THE VOTER-APPROVAL TAX RATE; CALLING APUBLIC HEARING ON THE PROPOSED TAX RATE nqCREASE TO BE HELD ONSEPTEMBER 20, 2022; CALLING A PUBLIC HEARING ON THE BUDGET FOR THEFISCAL YEAR 2022-2023 ANNUAL PROGRAM OF SERVICES OF THE CITY OF DENTON TO BE HELD ON SEPTEMBER 20, 2022; REQUIRnqG THE PUBLICATION AND POSTINGOF NOTICES OF THE PUBLIC HEARINGS AND MEETINGS IN ACCORDANCE WITHTHE LAW; AND PROVDngG AN EFFECTIVE DATE. WHEREAS, the City Council desires to adopt the Fiscal Year 2022-2023 Annual Program of Services (“Budget”) for the City of Denton, Texas; and WHEREAS, in order to adopt the Budget, the City Council must hold a public hearing on the Budget and provide notice of same in accordance with Article VIII “Budget“ of the City Charter and other applicable law; and WHEREAS, the City Council desires to consider adopting a tax rate of $0.575682 per $ 100 valuation, which will exceed the lower of the no-new-revenue tax rate or voter-approval tax rate, in accordance with the requirements of the Texas Local Government Code Chapter 140 and TaxCode Chapter 26, as applicable: NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The findings set forth in the preamble of this Resolution are incorporated by reference into the body of this Resolution as if fully set forth herein. SECTION 2. The City Council desires to consider adopting a tax rate for the 2022 tax year of $0.575682 per $100 valuation that will exceed the lower of the no-new-revenue tax rate or the voter-approval tax rate. SECTION 3. The City Council hereby approves the placement of an item on the September 27, 2022, City Council public meeting agenda to vote on a proposed tax rate of §O.575682 per $100 valuation that will exceed the lower of the no-new-revenue rate or the voter approval tax rate. The meeting to vote on a proposed tax rate will not be held until notice of the meeting to vote on a proposed tax rate has been published in the Denton Record Chronic ie , a newspaper having general circulation within the City, in the form of the attached Notice of Meeting to Vote on Tax Rate, which is made a part of this Resolution for all purposes. The City Manager or their designee is directed to post the attached Notice of Meeting to Vote on Tax Rate prominently on the City’s home page of the Internet website and shall request that the City’s public access television channel carry a 60-second notice of the meeting to vote on a proposed tax rate. SECTION 4. The City Council hereby calls p public hearing on the proposed tax rate to be held at City Hall located at 215 East McKinney Street in Denton, Texas 76201 on September 20, 2022, at 6:30 p.m. The public hearing will not be held until after notice of the public hearing has been published in the Denton Record-Chronicle , a newspaper having general circulation withinthe City, in the form of the attached Notice of Public Hearing on Tax Increase, which is made a part of this Resolution for all purposes. The City Manager, or their designee, is hereby directed to publish said notice in accordance with this Resolution and in accordance with applicable law. The City Manager or their designee is also directed to post the attached Notice of Public Hearing onTax Increase prominently on the home page of the City’s Internet website, and further, shall request that the City’s public access television channel carry a 60-second notice of the public meeting in the manner, at the times, and for the periods required by law. At the public hearing,the City Council will afford adequate opportunity for both proponents and opponents of the proposed tax rate to present their views. SECTION 5. The City Council hereby calls a public hearing on the proposed Budget to be held at City Hall located at 215 East McKinney Street in Denton, Texas 76201 on September 20, 2022 at 6:30 p.m. The public hearing will not be held until notice of the public hearing has been published in the Denton Record-Chronicle, a newspaper having general circulation within the City, in the form of the attached Notice of Public Hearing on Budget, which is made a part of this Resolution for all purposes. This notice shall be published not earlier than the 30th or later than the 10th day before the date of the public hearing. The City Manager, or their designee, is hereby directed to publish said notice in accordance with this Resolution and in accordance with ArticleVIII of the City Charter, Chapter 102 of the Texas Local Government Code, and all other applicable law. The City Manager, or their designee, is also directed to post the attached Notice of Public Hearing on Budget prominently on the home page of the City’s Internet website and shall request that the City’s public access television channel carry a 60-second notice of the public hearing in the manner, at the times, and for the periods required by law. At the public hearing, the City Council will aaord adequate opportunity for both proponents and opponents of the proposed budget to present their views. SECTION 6. This Resolution shall become effective immediately upon its passage and approval at a regular meeting of the City Council of the City of Denton, Texas on this the 16th day of August, 2022, at which meeting a quorum was present and the meeting was held in accordance with the provisions of Tex. Gov’t Code §551.001, er seq. PROPOSED TAX RATE $0.575682 per $100 NO-NEW-REVENUE TAX RATE $0.511429 per $100 VOTER-APPROVAL TAX RATE $0.603743 per $100 The no-new-revenue rate is the tax rate for the 2022 tax year that will raise the same amount of property tax revenue for CITY OF DENTON from the same properties in both the 2021 and 2022 tax year. The voter-approval rate is the highest tax rate that CITY OF DENTON may adopt without holding an election to seek voter approval of the rate. The proposed tax rate is greater than the no-new-revenue tax rate. This means that CITY OF DENTON is proposed to increase property taxes for the 2022 tax year. A PUBLIC HEARING ON THE PROPOSED TAX RATE WILL BE HELD ON SEPTEMBER 20, 2022 AT 6:30PM AT DENTON CITY HALL 215 E. MCKINNEY STREET, DENTON, TX 76201 A PUBLIC MEETING TO VOTE ON THE PROPOSED TAX RATE WILL BE HELD ON SEPTEMBER 27, 2022 AT 6:30PM AT DENTON CITY HALL 215 E. MCKINNEY STREET,DENTON, TX 76201. The proposed tax rate is not greater than the voter-approval tax rate. As a result, CITY OF DENTON is not required to hold an election at which voters may accept or reject the proposed tax rate. The 86th Texas Legislature modified the manner in which the voter-approval tax rate is calculated to limit the rate of growth of property taxes in the state. The meeting will be held for the purpose of receiving community input on the Budget. A public meeting to vote on the Budget will be held on September 27, 2022 at 6:30pm at Denton City Hall 215 E. McKinney Street Denton, TX 76201. THIS BUDGET WILL RAISE MORE TOTAL PROPERTY TAXES THAN LAST YEAR’S BUDGET BY $7,853,242 OR10.28% AND OF THAT AMOUNT $392399066 1S TAXREVENUE TO BE RAISED FROM NEW PROPERTYADDED TO THE TAX ROLL THIS YEAR.
