HomeMy WebLinkAbout22-1820RESOLUTiON NO. 22-1820 A RESOLUTION OF THE CITY OF DENTON ADOPTING POLICY NO. 107.11 “PAIDPARENTAL LEAVE” AND INCLUDING IT IN THE CITY OF DENTON POLICIES AND PROCEDURES; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Denton values the health, wellness, and work/life balance of its employees and wishes to create a policy to provide up to six (6) weeks of paid leave for eligible employees following the birth, adoption, or foster placement of a child; and WHEREAS, staff developed the policy based upon direction provided by City Council on March 22, 2022 and during development of the FY22-23 budget process; and WHEREAS, on Sept. 27, 2022, City Council approved the FY22-23 budget, which included funding a supplemental for up to six (6) weeks of Paid Parental Leave; WHEREAS, the City Manager recommends adoption of a policy and the City Councildesires to adopt such policy; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The recitals and findings contained in the preamble of this resolution are incorporated into the body of this resolution. SECTION 2. The Policy Statement in “Policy No. 107.11 “Paid Parental Leave”, which is incorporated in this section, is hereby adopted as an official policy of the City of Denton: POLICY STATEMENT The City of Denton shall provide paid parental leave to employees following the birth of an employee’s child or the placement of a child with an employee through adoption or foster The purpose of this policy is to enable eligible employees to care for and bond with a newborn or newly adopted or newly placed foster child SECTION 3. This Resolution only adopts and approves the “Policy Statement” portion of the Paid Parental Leave Policy included in No. 107.11 of the City of Denton Policies and Procedures Manual. The “Administrative Procedures” portion of the Paid Parental Leave Policy is not a policy of the City Council but rather an administrative procedure describing the means and methods by which City management implements the Paid Parental Leave Policy. The City Manager is authorized to amend and issue such administrative procedures and directives as deemed necessary to implement the Paid Parental Leave Policy related to personnel and internal operational matters. SECTION 4. The attached policy shall be filed in the official records with the City Secretary. SECTION 5. This Resolution, upon its passage and approval, shall be made effective retroactive to October 1, 2022 to align with the start of the new fiscal year and approved funding. ProceduresPolicy Type: October 1, 2022Effective Date POLICY STATEMENT The City of Denton shall provide paid parental leave to employees following the birth of an employee’s child or the placement of a child with an employee through adoption or foster care. The purpose of this policy is to enable eligible employees to care for and bond with a newborn or newly adopted or newly placed foster child. DEFINITIONS “Child” – newborn or newly adopted or newly placed child in foster care. “Parent” – biological parent of a newborn or identified parent of a newly adopted child, or identified foster parent of a child “12-month period” – a rolling 12-month period measured backward from the date leave is taken. ADMINISTRATIVE PROCEDURES I. Eligibility A. In order to be eligible for paid parental leave, an employee must be eligible for leave under the Family and Medical Leave Act (FMLA) by meeting the following criteria: 1.Have been employed for at least 12 months by the City of Denton prior to the commencement of the leave (12 months need not be consecutive except that time worked prior to a break in service that lasted seven years or more will not countunless the break in service was due to service covered by the Uniformed Services Employment and Reemployment Rights Act (USERRA); 2. Have worked at least 1,250 hours during the 12-month period immediately prior to the commencement of the leave; and, 3. Be regularly scheduled to work 20 or more hours per week in a full-time or part- tlrne posltlon. B. Temporary or seasonal employees or interns are not eligible for paid parental leave. C. In addition, employees must meet one of the following criteria: 1. The birth of an employee’s child; 2. The adoption of a child; or Policy 107.11 Paid Parental Leave Page 1 of 3 the 12-month FMLA period. Please refer to City of Denton policy 107.04 for further guidance on FMLA. B. After the paid parental leave is exhausted, the balance of FMLA leave, if applicable, will be compensated through the employee’s accrued sick and vacation leave. Upon exhaustion of accrued sick and vacation leave, any remaining leave will be unpaid. C. The City of Denton will maintain all benefits for employees during the paid parental leave period just as if they were taking any other paid leave. D. If a City holiday occurs while the employee is on paid parental leave, the absence will be charged to holiday pay; however, such holiday will not extend the total paid parental leave entitlement period and the employees paid parental leave balance will be adjusted accordingly. E. F. Working at any City location or any secondary employment location while receiving paid parental leave will result in the forfeiture of any remaining paid parental leave. Where requirements are not expressly stated in this policy, the provisions of the FMLA shall apply including time periods for requesting leave. (e.g. An employee’s entitlement to FMLA leave for the placement of a child for adoption or foster care expires 12 months after the placement.) IV. Request for Paid Parental Leave A.The employee must provide the Human Resources department with notice of the request for leave at least thirty (30) days prior to the proposed date of leave (or if leave was not foreseeable, as soon as possible). The employee must complete the necessary forms and provide all documentation as required by the Human Resources department to substantiate the request. B. The decision regarding the request for leave will be provided in writing within ten (10) business days of receipt of the request. C. As is the case with all policies, the City of Denton has the exclusive right to interpret this policy.
