HomeMy WebLinkAbout22-2535RESOLUTION NO. 22-2535 A RESOLUTION OF THE CITY OF DENTON ADOPTING AN UDPATED POLICY NO 106.07 “LONGEVITY PAY” OF THE CITY OF DENTON POLICIES AND PROCEDURES;AND DECLARING AN EFFECTIVE DATE. WHEREAS, Administrative Policy 106.07 “Longevity Pay” (the “Policy”) was initially adopted on November 5, 1985; and WHEREAS, the Policy was last revised on August 25, 2003; and WHEREAS, the City provides longevity pay for civil service employees in accordance with the requirements of the Texas Local Government Code Section 141.032; and WHEREAS, the City values tenured employees and extended longevity pay to full-time non-civil service employees per the Policy; WHEREAS, staff developed revisions to the Policy to reflect the requirements of Texas Local Government Code Section 141.032, including a provision that the calculation for longevity pay for a civil service police officer or fire fighter includes any prior time of service employed by the City of Denton as a police officer or fire fighter; and WHEREAS, staff also made other language clean-ups and clarifications to the Policy; and WHEREAS, the City Manager recommends adoption of a revised policy and the CityCouncil desires to adopt such policy; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The Policy Statement in “Policy No. 106.07 Longevity Pay”, which is incorporated in this section, is hereby adopted as an official policy of the City of Denton: POLICY STATEMENT Longevity pay is provided to full-time regular employees to encourage the retention of employees by recognizing the value of long-term service with the City SECTION 2. This Resolution only adopts and approves the “Policy Statement” portion of the Death in the Family Leave Policy included in No. 106.07 of the City of Denton Policies and Procedures Manual. The “Administrative Procedures” portion of the Longevity Pay Policy is not a policy of the City Council but rather an administrative procedure describing the means and methods by which City management implements the Longevity Pay Policy. The City Manager is authorized to amend and issue such administrative procedures and directives as deemed necessary to implement the Longevity Pay Policy related to personnel and internal operational matters. SECTION 3. The attached policy shall be filed in the official records with the City Secretary . SECTION 4. ADMINISTRATIVE PROCEDURES I. NON-CIVIL SERVICE EMPLOYEES A. An employee must be employed on or before May 31st and be employed in a full-time position the date the check is issued to receive longevity pay in that calendar year. B. Accrual is at the rate of $4.00 per month for each month of uninterrupted service. (Example: 48 months of service would result in a payment of $192.00.) C. Payment is to be made in a lump sum each year during the month of November. D. Employees retiring or moving from a regular full-time status to a regular part-time status one month (i.e., October) before longevity checks are issued will be entitled to the total longevity pay less $4.00 for the month the employee retired or changed status prior to longevity check distribution. II. CIVIL SERVICE EMPLOYEES Section 141.032 of the Texas Local Government Code mandates payment of $4.00 per month for each year of service, not to exceed 25 years, to employees who are Firefighters or licensed Peace Officers. A. Eligibility commences after one year of service. B. Accrual is at the rate of $4.00 per month for each year of service as a City of Denton Firefighter or licensed Peace Officer, regardless of any breaks in service. (Example: employed as a Firefighter for 24 months beginning in 2015 and returned to the City of Denton for an additional 24 months in 2020. Longevity pay would be based on 48 months.) C. Payment is to be included on the regular paycheck.
