HomeMy WebLinkAbout23-876RESOLUTION NO. 23-876 A RESOLUTION OF THE CITY OF DENTON AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE TEXAS DEPARTMENT OF TRANSPORTATION’S 2023 TRANSPORTATION ALTERNATIVES SET-ASIDE (TA) PROGRAM IN THE AMOUNT OF$13,346,259 FOR THE INSTALLATION OF 3.25 MILES OF THE PECAN CREEK TRAILSHARED USE PATH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Texas Department of Transportation (TXDOT) issued a call for projects in December 2022 for communities to apply for funding assistance through the Transportation Alternatives Set-Aside (TA) Program; and WHEREAS, the TA funds may be used for development ofpreliminary engineering (plans, specifications, and estimates and environmental documentation) and construction of pedestrian and/or bicycle innastructure; and WHEREAS, the TA funds require a local match, comprised of cash or Transportation Development Credits (TDCs), if eligible. The City would be responsible for all non-reimbursable costs and 100% of overruns, if any, for TA funds; and WHEREAS, the City of Denton is eligible to apply for the funds under the application criteria; and WHEREAS, the City has developed the necessary application materials and desires to make an application to the TXDOT TA Program; and WHEREAS, grant applications are due on June 5, 2023 and requests that the applying entity adopt a resolution authorizing the submittal of the grant application prior to the grant application deadline; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The application for the TXDOT 2023 TA Program is hereby authorized. SECTION 2. The City Manager, or designee, is designated, delegated, and authorized torequest grant funding under the TXDOT 2023 TA Program, including the submission of TXDOT’s application, and act on behalf of the City of Denton in all matters related to the grant application, receipt of funds, and any subsequent grant contracts, agreements, and grant projects that may result SECTION 3. Should the project be funded, then the City of Denton shall comply with the requirements of the TPWD and the State of Texas. SECTION 4. The City of Denton supports funding this project as described in the 2023 TA Detailed Application (including the preliminary engineering budget, if any, construction budget, the department’s direct state cost for oversight, and the required local match, if any) and is willing to commit to the project’s development, implementation, construction, maintenance, management, and financing. SECTION 5. The City of Denton is willing and able to enter into an agreement with TXDOT should the project be selected for funding. SECTION 6. The project funds and any project-funded equipment and facilities will be used solely for the purposes for which they are intended under the grant. SECTION 7. This resolution is effective immediately upon its passage.
