TEXAS HELD 'AT THE MUNICIPAL BUILDING IN SAID CITY ON ~ 26TH
DAY O~ ~EBRUAHY, A.D.
HEREAS, by deed recorded in Vol. 418, Page 98 of the Deed
Records of Denton County, .Texas, the City of Denton, Tex~$,
pursuant to a resolution adopted January 11, 1955 and recorded
in Vo1. 15, Page 337 of the minutes of the City Commission of
the C~ty of Denton, and Denton County, Texas, pursuant to a
resolution adopted on January 17, 1955 and recorded in Vol. T,
Page 428 of the Commissioners' Court Minutes of Denton County,
Texasl, conveyed approximately 1.23 acres of land to the Gulf,
Colorado and Santa Fe Railway Company for right-of-way purposes;
and
WHEREAS, the said 1.23 acre tract of land crosses the
TexasI National Guard Armory site which originally contained 10
acre~; and
IWHEREAS, as consideration for the said 1.23 acre tract, the
Gulf, Colorado and Santa Fe Railway Company agreed to replace
the ~aid land in kind with additional land adjoining the said
Texas National Guard Armory site, said replacement to be sat is-
factory to the City of Denton, Denton County and the Texas
National Guard Armory Board; and
1~tEREAS, the Gulf, Colorado and Santa Fe Railway Company
has ~ow reached a~ agreement with W. C. Potter and wife, Maydell
Wallace Potter wherein the said W. C. Potter and Maydell Wallace
Potter will convey approximately 1.0 acre of land adjoining the
Eastl side of the Texas National~ Guard Armory site to the City
of D~nton, Texas, and ~e~ton County, Texas, in fulfillment of
the ~ailway company,s original agreement; and
I ~EtEREAS, the said l~0 acre tract of land will provide access
to ~. S. HiEhway 35E along the entire frontage of the TexaS
Guard Armory site; now therefore be it
ESOLVED BT THE CITY COUNCIL OF ~HE CITY OF DENTON, TEXAS,
that, subject to approval and acceptance by Denton County, Texas,
and the Texas National Guard Armory Board, the City of Denton,
Texas~ hereby accepts the~cnnveyance of approximately 1.O acre
of la~d from W. C. Potter and wife, Maydell Wsllace Potter, to
the City of Denton, Texas, and Denton County, Texas, said land
being~more fully described as follows, to wit:
All that certain traet or parcel of land out
6f the Eugene ~uchalski Survey, Abstract No. 996,
Denton County, Texas, being part of an 84 acre tract
bf land conveyed to W. C. Potter and Wife, Maydell
Wallace Potter, by M~dland Life Insurance Company
by deed dated May 21, 1940, recorded in Volume
284, Page 83, Deed Records of Denton County, Texas,
more particularly described as follows:
BEGINNING at the Southeast corner of a l0 acre
tract of land conveyed to City of Denton, Texas,
and County of Denton, Texas, by W. C. Potter and
wife, Maydell Wallaee Potter, by deed dated
December 18, 1952, recorded in Volume 383, Page
187, Deed Records of Denton County, Texas, said
Southeast corner being in the South line of said
84 acre tract; thence South 88~ 53' East along
said South line, 330.5 feet to point for corner
in the Southwesterly right of way line of U. S.
Highway No. 77;
HENCE Northwesterly along said Southwesterly
right-of-way line, being along a curve to the right
having a radius of 4453.6 feet, concentric with and
150.0 feet radially distant Southwesterly from the
eenterline of said U. S. Highway No. 77 420.3 feet
to point for corner in the East line of said 10
ere tract;
HENCE 8outh 1~ 07~ West along said East line,
265.0 feet to the place of beginning, containing
1.0 acre of land, more or less;
and be it further
RESOLVED, that the aforesaid 1.0 acre tract be and it is
hereby accepted by the City of Denton, Texas, as a final and
complete discharge of the Gulf, Colorado and Santa Fe Railway
Company,s obligations in connection with the conveyance of the
1.23 acre right-of-way by the City of Denton, Texas, by deed
of re~ord in Vol. ~18, Page 98 of the Deed Records of Denton
Countv, Texas; and be it ~urther
RESOLVED, that the City Manager of the City of Denton,
Texasl, be and he is hereby authorized to enter into, execute
and dleliver on behalf of the City of Denton, Texas, a lease
of the aforesaid 1.0 acre,tract of land to the Texas National
Guard!Armor~y Board for and in consideration of the sum of
Ten Dollars for a term of years to expire with the original
leasehold of the Texas National Guard Armory Board.
