R E S......0....~ U T I 0.N WHEREAS, Russell-Newman Manufacturing Company has contracted for certain remodeling work to be performed on their building adjacent to Austin Street in the City of Denton, Texas; and WHEREAS, the said contract is said to be completed within from this date; and WHEREAS, in order to perform such remodeling work it appears, from evidence presented to the City Council, that the temporary obstr~ction of the East side of Austin Street and adjacent side- walk lalong the said Russell-Newman Manufacturing Company premises to a distance of fourteen (l~) feet West from the East curb line of Austin Street will be necessary; and WHEREAS, the City Council has been requested by Russell- Newman Manufacturing Company to permit such temporary obstruction of the aforesaid portion of Austin Street in order to permit such remodeling work; and WHEREAS, it appears that such request is reasonable and thatlsuch temporary obstr~ction is necessary and proper and does not unreasonably and unnecessarily impair the public use of said street; now therefore BE IT REd0LVED BY THE CITY COUNCIL OF THE CITY 0F DENTON, TEXAS, that Davis Brothers, contractors, be and they are hereby grante~leslon to temporarily obstruct, for a period of not to exe~d ~wo (2, ,.u~ilJ from the date of this resolution, that port,on of Austin Street.and adjacent sidewalk in the said City of D~nton, Texas, adjacent to the said Russell-Newman Manufacturing Company premises and extending West into Austin Street a distance of not to exceed fourteen (14) feet from the East curb line of said Austin Street, in order to perform the aforesaid remodeling work for the said Russell-Newman Manufacturing Company; it being a condition of the permit granted hereunder that the said Davis Brothers, contractors, and the said Russell-Newman Manufacturing Company by the acceptance and use of the permit granted hereunder, assume full and complete responsibility of erecting proper barriers and warning flares in order to protect the public from injury and/or damage resulting from such temporary obstruction; and be it further RESOLVED, that the acceptance of the permit granted to tempo- rarily obstruct Austin ~treet and adjacent sidewalk, as aforesaid, shall.constitute an agreement by the said Davis Brothers, con- tractors, and Russell-Newman Manufacturing Company to save and hold She City of Denton Harmless from any and all claims for damages or injury arising out of or in any manner connected with the temporary obstruction of Austin Street and adjacent sidewalk, as afsresaid. RES.OLUT I ON W~B~EA$, House Bill No. 645 has been Introduced in the Texas Legislature by Representative Joe Ratcliff of Dallas; proposing roi change the name of North Texas State College to The University of North Texas; and W~S, it seems particularly appropriate to recognize in name the status of a great institution of higher learning achieved many years ago in fact by the dedicated and distinguished efforts of its faculty and student body; and WEEREAS, the City of Denton and its citizens enthusiasti- cally approve House Bill No. 645 and wish to respectfully petition the Legislature of the State of Texas to enact the same; now therefore be it RP~OLV~D by the City Council of the City of Denton, Texas, that the City of Denton, Texas~ does hereby endorse and approve the provisions of House Bill No. 645 proposing to change the name of North Texas State College to The University of North Texas; and be it further RES(~LVED~ that the City Secretary of the City of Denton, be; and he is hereby, authorized and directed to forward copies of this Resolution to Representative Alonzo Jamison and Senator Tom Creighton in evidence of the petition of the City of Denton; Texas, and its citizens; to the Legislature of the State of Texas for the passage of House Bill No. 645. PASSED A/~D APPROV~ this 14th day of March, A.D. 1961. ayoe Clty of Denton, Texas ATTEST: C~ity SeC~tary City of Denton~ Texas i ~:y At~orhey City of Denton, Texas RESOLUTION Dentoll~ Texas WHEREAS, the Cmties of Denton and Dallas are part of a rapxdly grow~g metropolitan area with common Lnterests Ln the continued economic growt~ and prosperity of the area; and WHEREAS, adequate supply of water for municipal and 2ndustrmal purposes ~s vital to the continued growth and prospermty of the area; and W~I~AS, Denton and Dallas now obtain water from the Garza-Llttle Elm Reservoir; and WH~tEAS, the most apparent economical solution to the water supply needs of both citmes requires the ~ utmlxzatlon of the exmst~-ng supply ~n Garza-Lxttle Elm Reservoir to be followed by coordinated develop- ment 9f the Aubrey Reservoir and mnclud~ng an exchange of storage between the two; and W~F.~S, the carrying out of an econommcal and adequate plan of future development of the water resources of the Elm Fork of the Trinity River! and other potentmal sources of the area can best be accomplxshed thro$ a cooperative effort between the cltmes of Denton and Dallas; Now, Therefore, BE IT ~SOLVED that this Commxttee make the following recon~nen- dat~ons to themr respectmve City Councils: 1. That the C~ty Councsls of Denton and Dallas adopt the prLncxple of a cooperatxve effort ~n further development of the water resources of the Elm Fork of the Tr~nxty Rxver and other potentmal sources of the area; and 2. That such a plan ~nclude the max~nn~a utmlmzatlon of the present water[ supply in the Garza-Lxttle Elm Reservomr by sale of water to the Ciity of Denton by the Cmty of Dallas to defer capmtal ~nvestment n ~he proposed Aubrey Reservoir until such tune as the jomnt requmrements of both c~txes require ~ts construction; and 3. That at such t~me as the supply ~n Garza-Little Elm Reservoir becomes inadequate to meet the needs of the c~tmes of Denton and Dallas, then the two citxes w~ll cooperate ~n financing and constructmon of the proposed Aubrey Reservoir; and 4. That each City Council mnstruct its admin~stratmve personnel to meet for the purpose of developmng contractual arrangements between the two cities that will equitably effectuate the fore§orang recommendatmons and statement of general polmcy contained here~n.
