HomeMy WebLinkAbout1961-9AT A R~ULAR,NEBTING OF THE CITY COUNCIL OF THE CITY OF T~XAS~ HELD IN THE ~ICIFAL BUILDING IN SAID CITY ON THE 10TH DAY OF O~I~)B~R~ it.D, 1961. q~EREAS~ the closing ,of tho Southern Ho;el in the City o£ Denton, Texas~ in 1960, resulted in a critical shortage of housing ace~dations in the Clgy of Denton for visitors to tho City and for the travelin~ public; and M~[~qBA~, early in 1961, a p~oposal was made by a group si interested businessmen and the officials of l~orth Texas State University and Tens ~omen*o University for the solutio~ of the said er/t/cai transient housin~ short:age by the flnmediate con- struction of a luxury motel adequate to meet the present and uture needs of the City o£ Denton at the intersection of Dallas Drive and Interstate Hi~ay 35E; and bqt~RRAS, on April 17, 1961, the City Council of the City of Denton vas requested by the said interested businessmen and university otfieials to cooperate in the arrangements necessary to secure said ~uxury motel facilities flor the City si Denton by providin~ utility e~ten~lon8 to the proposed site si said motel at an approximate cOSt of $70500, and HEREAS, because of the critical need for such accva~oda- tions end the desire of the Cl~y Council to cooperate with the said businessmen and university o£[icials, the City Council on April 17, 1961, by motion, approved the expenditure o~ funds to provide tho a~oresaid utility extensions and granted an exception to the es~eblished policy si requiring PA~$ED Zttq9 AIPI~VED this X0t;h ~ay o£ OoCober, A.D. RESOLUTION WHEREAS, under the provisions of Article 1085b, Revised Civil Statutes of Texas, Home Rule Cmties have the power and authority to grant the use of portions of the streets and szdewalks of such citmes for private purposes, for such consideratzon and upon such terms as they may prescribe, provided, however, such use does not interfere with the public use of such streets and szdewalks, or create any hazardous or dangerous conditions thereon, and WHEREAS, Texas Woman's University has applmed to the City Council of the City of Denton, Texas, for an easement permztting the construction of an overhead passageway over certain portions of Bell Avenue in the City of Denton, Texas, now therefore be zt RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that Mayor Frank Barrow be, and he zs hereby, authorized to execute on behalf of the Cmty of Denton, an easement to Texas Woman's University for the construction of an overhead passageway over certain portions of Bell Avenue in the Clty of Denton, Tex~ to be more particularly descried in the said easement, provided, however, that said easement shall not authorize any mnterference with the ~ublic use of Bell Avenue. RESOLUTION WHEREAS, the City of Denton, Texas, in the construction of an underground eighteen (18) inch water pipe line desires to cross the right-of-way of the Texas and Pacific Railway Company at the following location mn the City of Denton, Denton County, Texas: Valuation Chaining Station 10986+36.9, Mile Post A-208.1, Main Lzne, Eastern Division, and WHEREAS, the City of Denton, Texas, has requested the Texas and Pacific Railway Company to enter into a Pipe Line Agreement authorizing the crossing of the Texas and Paczf~c right-of-way, as aforesaid, now therefore be it RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that Mayor Frank Barrow be, and he is hereby, authorized to sign on behalf of the City of Denton, Texa~ a Pipe L~ne Agreement with the Texas and Pacific Railway Company in order to authorize the crossing of the Texas and Pacific Railway Company's right-of- way with an eighteen (18) inch water pipe line, as aforesaid. RESOLUTION WHEREAS, Ordinance No. 55-82, passed and approved by the Czty Commission of the City of Denton, Texas, on the 31st day of October, 1955, declared the necesszty for the permanent improve- ment of a certain portion of a public street described as 965 feet of Houston Place lyzng immediately West of the West boundary line of Bradley Street, in the City of Denton, Texas, and WHEREAS, the Cmty Commission of the City of Denton, Texas, by said ordinance, provzded that a portzon of the cost of such mmprovement would be assessed against the abutting propertzes and the owners thereof, said assessment to constitute a first and przor lzen upon all such properties and a personal liabzlity of the real and true owners thereof; and WHEREAS, thereafter, on the 6th day of June, 1956, a notzce of the enactment of said ordinance was filed wzth the County Clerk and recorded in Volume 422, Page 249 of the Deed Records of Denton County, Texas, and WHEREAS, the improvement ordered by the samd Ordmnance No. 55-82 was never constructed and the filzng of the notice of enact- ment of the said ordinance has created a cloud upon the t~tle of the abutting properties; now therefore be mt RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that Mayor Frank Barrow be, and he is hereby, authorized to execute a release of the assessment ordered by Ordinance No. 55-82 for the permanent improvement of 965 feet of Houston Place lying iramediately West of the West boundary llne of Bradley Street, in the City of Denton, Texas, so that the same may be filed in the Deed Records of Denton County, Texas, for the purpose of removmng the cloud cast upon the title of the abutting properties, as aforesaid. RESOLUTION WHEREAS, 300,000 Texans are mentally retarded, and the num- ber is increasing by 7,500 each year in our State, and WHEREAS, there are 5,000,000 mentally retarded children in the United States, and WHEREAS, retarded children with training and educational faczlities geared to their special needs can be made happier, more productive members of our communities, and WHEREAS, the Texas Association for Retarded Chzldren, Inc., and the National Association for Retarded Children, Inc., are providing servzces and are workmng to develop needed training and educational facilities; and WHEREAS, success of their appeal for funds to axd thzs work will benefit our State by making possible expanded research and trainzng programs, with the goal of more effectmve care, training, and rehabilitation of those afflicted in Texas and throughout the Nat~on, now therefore be it RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that the period from November 12-23 be designated as "Retarded Children's Week". RESOLUTION WHEREAS, the City Council of the City of Denton, Texas, has authorized a program of constructzon of sewage works at an estz- mated cost of Nine Hundred Fifty-four Thousand, Seven Hundred Twenty-seven Dollars ($954,727.00) and the Unzted States Govern- ment, acting through the Public Health Service, has offered a Federal grant in the amount of Two Hundred and Fifty Thousand Dollars ($250,000.00) as designated on Part A, Offer and Acceptance, now under consideration by thms body, now therefore be it RESOLVED BY THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, that said offer as submitted, together with the terms and condl- tlons thereof, is hereby accepted and approved, and Mayor Frank Barrow is hereby authorized and dlrected to s~gn sa~d Offer and Acceptance and any other necessary documents required to complete the project on behalf of said City of Denton, Texas, and be it further RESOLVED, that the City of Denton, Texas, has or will procure a fee simple or such other estate or interest in the site of the project, including the necessary easements and rlghts-of-way, as to assure undisturbed use and possession for the purposes of con- struction, operation and maintenance of the works for the estimated l~fe of the project and that in the event such title~ estate, or interest in such site, easements or rights-of-way may in the future be contested~ the City of Denton, Texas, will defend and maintain its title xn such site and hold the United States Government blame- less in such action.
