HomeMy WebLinkAboutR2006-023S.\Our Documents\Resolutions\06\Section 108 App Resolulion.doc RESOLUTION NO.D 23 A RESOLUTION OF THE CITY OF DENTON, TEXAS, AUTHORIZING THE CITY MANAGER TO SIGN AND SUBMIT, TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AN APPLICATION FOR A CDBG SECTION 108 LOAN GUARANTEE WITH APPROPRIATE CERTIFICATIONS, AS AUTHORIZED AND REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Denton, Texas, is concerned with the development of viable urban communities, including decent housing; and WHEREAS, the City of Denton, Texas, has a special concern for persons of low and moderate income that currently reside in substandard housing; and WHEREAS, the City of Denton, Texas, wishes to submit a CDBG Section 108 Loan Guarantee Program application requesting funds to support the City's existing Home Improvement Loan Program in the approximate amount of $650,000; and WHEREAS, pursuant to federal regulations, the City of Denton, Texas has adopted a Citizen Participation Plan for the citizens to publicly comment on citizen participation requirements and proposed activities, and staff has complied with the Citizen Participation Plan, including the holding of public hearings; and WHEREAS, the City of Denton's Consolidated Plan for Housing and Community Development has been amended to include CDBG Section 108 Loan Guarantee funds as a potential source for housing rehabilitation and reconstruction programs within the City; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The City Council of the City of Denton, Texas, authorizes the City Manager to sign and submit to the Department of Housing and Urban Development an application for CDBG Section 108 Loan Guarantee funding and appropriate certifications, including a certification providing assurance that the City has the legal authority to make the pledge of grants required under CFR 570.705 (b) (2), for funding under the Housing and Community Development Act of 1974, as amended, and the City Manager is authorized to exercise all rights and duties of the City under this application. SECTION 2. The City Council of the City of Denton, Texas, authorizes the Community Development Administrator to handle all fiscal and administrative matters related to the application. SECTION 3. The City Secretary is hereby authorized to furnish copies of this resolution to all interested parties.
