A RESOLUTION OF THE CITY OF DENTON FINDING AND DETERMINING THAT THENUMBEROFINHABITANTSINTHECITYOFDENTONISINEXCESSOF100,000; ANDPROVIDINGANEFFECTIVEDATE
WHEREAS, Chapter 42 of the Texas Local Government Code establishes theextraterritorialjurisdictionofamunicipality; and
WHEREAS, Section 42.021 of the Texas Local Government Code establishes theextraterritorialjurisdictionofamunicipalitytobewithinfivemilesofitsboundaries, in the caseofamunicipalitywith100,000 or more inhabitants; and
WHEREAS, the July 1, 2004 population of the City of Denton as estimated by the U.S.Bureau of the Census was 98, 288 as set forth by the Bureau in its July 12, 2005 publication; and,
WHEREAS, based on City building permit, certificate of occupancy, and utilityconnectionrecords, other data available to the City, and reliable demographic and statistical
analysis, the number of Denton inhabitants exceeds 100,000; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES:
SECTION 1. The findings and recitations contained in the preamble of this resolution
are incorporated herein by reference and are true and correct.
SECTION 2. The City Council hereby finds and determines that the number ofinhabitantsintheCityofDentonexceeds100,000.
SECTION 3. This resolution shall become effective immediately upon its passage and
approval.
