HomeMy WebLinkAboutR2004-043A RESOLUTION OF THE CITY OF DENTON CITY COUNCIL REQUESTING THE TEXAS MUNICIPAL LEAGUE TO SUPPORT LEGISLATION THAT AUTOMATICALLY REMOVES THE AD VALOREM TAX EXEMPTION OR REDUCES THE AD VALOREM TAX EXEMPTION TO THE RATIO OF STUDENT OCCUPATION FOR HIGHER EDUCATION AUTHORITIES; AND PROVIDING AN EFFECTIVE DATE. WItEREAS, the Texas Mtmicipal League will hold its annual conference on October 27-29, 2004 in Corpus Christi, Texas; and WltEREAS, Chapter 53 of the Texas Education Code allows cities to create Higher Educational Authorities or nonprofit corporations acting on their behalfto acquire educational facilities or housing facilities for students; and WHEREAS, these housing facilities are often apartment complexes that receive an ad valorem tax exemption and may not have any students living in the apartments; and WHEREAS, local taxing entities are thereby deprived of needed property tax revenues; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. That the City Council requests that the Texas Municipal League support legislation that automatically removes the ad valorem tax exemption or reduces the ad valorem tax exemption to the ratio of student occupation for housing facilities of Higher Education Authorities. SECTION 2. That the City Manager is authorized to forward a copy of this resolution to Mr. Frank Sturzl, Executive Director of the Texas Municipal League. SECTION 3. That this resolution shall become effective immediately upon its passage and approval.
