A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, AUTHORIZING THE CITY MANAGER, AS DENTON'S AUTHORIZED REPRESENTATIVE, TO FILE A PROJECT APPLICATION WITH THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS ("NCTCOG") FOR A FUNDING OBJECTIVE ENCOMPASSING THE FOLLOWING: "CREATE AND EXPAND MULTI-FAMILY HOUSING RECYCLING PROGRAMS THROUGHOUT THE REGION"; AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO ACT ON BEHALF OF THE CITY OF DENTON, TEXAS IN ALL MATTERS RELATED TO THE APPLICATION; AND PLEDGING THAT IF A PROJECT IS RECEIVED THE CITY OF DENTON, TEXAS WILL COMPLY WITH THE PROJECT REQUIREMENTS OF THE NCTCOG, THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY, AND THE STATE OF TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the North Central Texas Council of Governments ("NCTCOG") is directed by the Texas Commission on Environmental Quality to administer solid waste project funds for implementation regarding the NCTCOG's adopted regional solid waste management plan; and WHEREAS, the City of Denton is qualified to apply for project funds under the Request for Projects; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY RESOLVES: SECTION 1. The City Manager or his designee is authorized to request project funding under the North Central Texas Council of Govemments' Request for Projects of the Regional Solid Waste Local Project Funding Program and act on behalf of the City of Denton, Texas in all matters related to the project application for a project to "Create and Expand Multi-Family Housing Recycling Programs Throughout the Region," and for all matters related to the project application and any subsequent project contract and project that may result. SECTION 2. That if the project is funded, the City of Denton, Texas will comply with the project requirements of the North Central Texas Council of Governments, the Texas Commission on Environmental Quality, and the State of Texas. SECTION 3. That the project fimds and any project-funded equipment or facilities will be used only for the purposes for which they are intended under the project. SECTION 4. That the activities will comply with and support the adopted regional and local solid waste management plans adopted for the geographical area in which the activities are performed. SECTION 5. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Denton, and it is accordingly so resolved.
