AUTHORIZING THE APPROVAL OF A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DENTON AND BONNIE BRAE BFR. LLC RELATING TO THE MODIFICATION OF THE BONNIE BRAE STREET PHASE 6 IMPROVEMENT PROJECT ADJACENT TO THE PROPERTY LOCATED AT 2205 NORTH BONNIE BRAE STREET: AUTHORIZING THE CITY MANAGER TO EXECUTE SAID DEVELOPMENT AGREEMENT; AND PROVIDING FOR THE RECEIPT OF FUNDS FROM BONNIE BRAE BFR, LLC IN THE AMOUNT OF EIGHTY-NINE THOUSAND, NINE HUNDRED AND SIXTY NINE AND 30/100 DOLLARS ($89,969.30); AUTHORIZING THE CITY MANAGER TO EXPEND SAID FUNDS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Bonnie Brae BFR, LLC (“Owner”) owns the approximately 16.97 acre property commonly known as 2205 North Bonnie Brae Street, depicted on Exhibit “ A“ attached hereto (“Subject Property”); and WHEREAS, the City is designing and constructing the Bonnie Brae Street Phase 6 Project, which is the widening of Bonnie Brae Street from a two (2) lane undivided to a four (4) lane divided roadway from University Drive (US380) to N Elm Street (US77) and is a component part of the larger multi-phase Bonnie Brae Street Improvement Project; and WHEREAS, Owner has requested City to design and construct, at Owner’s expense, an alternative vehicular element of a median cut for a hooded left-hand turn lane (hereafter, the “Project”) and make part of the Bonnie Brae Street Phase 6 Project plan set in order to support pedestrian, bicycle, transit, and vehicle connectivity between the Subject Property within the Bonnie Brae Street Phase 6 Project; and WHEREAS, to facilitate the completion of this work, the City and Owner desire to enter into a Development Agreement; and WHEREAS, the Owner will pay the City the full cost for the design and construction of the Project along the street frontage of Subject Property, an estimated amount of $89,969.30; WHEREAS, the City Council of the City of Denton deems it is in the public interest and serves a municipal and public purpose to enter into an agreement with Owner for the purpose of memorializing the Project additions to Bonnie Brae Street Phase 6 plan set. NOW, THEREFORE; THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. City Council finds that the Agreement between the City of Denton and Owner serves a valid municipal and public purpose and is in the public rnterest. SECTION 2. The Development Agreement between the City of Denton and Owner attached hereto as Exhibit “B” is hereby approved. The City Manager, or designee, is hereby authorized to execute the Development Agreement on behalf of the City of Denton. SECTION 3. The City Manager is hereby authorized to carry out the City’s rights and duties under the Agreement. SECTION 4. This Ordinance shall become effective immediately upon its passage and approval.
