AN ORDINANCE OF THE CITY OF DENTON, TEXAS DETERMINING UPON THE
NECESSITY OF ACQUIRING REAL PROPERTY AND AUTHORIZING THE PURCHASE FOR
PUBLIC USE, THE ACQUISITION OF APPROXIMATELY 0.6565-ACRES FROM THE STATE
OF TEXAS FOR THE USE AND BENEFIT OF UNIVERSITY OF NORTH TEXAS F/K/A NORTH
TEXAS STATE TEACHERS COLLEGE (“OWNER”), FOR A WATER, WASTEWATER AND
ELECTRIC EASEMENT (COLLECTIVELY, THE “PROPERTY INTEREST”) LOCATED IN
THE EUGENE PUCHALSKI SURVEY, ABSTRACT NO. 996, DENTON COUNTY, TEXAS, AND
BEING PART OF CITY OF DENTON IH 35N UTILITY RELOCATIONS (THE “PROJECT”)
ROW CSJ: 0195-03-074; AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO
CONSUMMATE AND ACCEPT THE PURCHASE, GRANT AND CONVEYANCE OF THE
PROPERTY INTEREST; AUTHORIZING THE EXPENDITURE OF FUNDS NOT TO EXCEED
ONE MILLION, SIX HUNDRED THOUSAND DOLLARS (SI,600,000.00) PLUS CLOSING
COST AND ESTIMATED EXPENSES OF $15,000.00 (TOTAL $1,615,000.00); AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, The Texas Department of Transportation (’TXDOT") right-of-way
expansion and improvement project, Segment CSJ 0195-03-074, requires the relocation of existing
City water, wastewater and electrical infrastructure from their current locations along the IH-35N
frontage road into new easements; and
WHEREAS, the acquisition of the Property Interests identified in Exhibit "A" is necessary
in furtherance of the Project, and to serve the public and the citizens of the City; and
WHEREAS, the City has agreed with the Owner of the Property, located at 2310 IH-35E,
Denton, Tx 76210, to pay a purchase amount of $ 1,600,000.00 plus closing cost and estimated
expenses of $15,000.00 acquiring real property and authorizing its purchase together shall not exceed
the authorized amount for public use; and NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings set forth in the preamble of this Ordinance are incorporated by reference
into the body of this Ordinance as if fully set forth herein.
SECTION 2. That public necessity requires that City acquire the Property Interests in the
Property for the Project.
SECTION 3. That the City Manager, or designee, is hereby authorized and directed to
consummate and accept the purchase, grant and conveyance to the City of the Property Interest in and to
the Property pursuant to the conveyancing instrument substantially in the form described in Exhibit “B”,
attached hereto and made a part hereof for all purposes, and to execute, deliver and receive such other
usual and customary documents necessary, appropriate and convenient to consummating this transaction.
SECTION 4. The City Manager, or designee, is authorized to expend funds in the amount of not
to exceed One million, Six Hundred Thousand And 00/100 Dollars ($ 1,600,000.00) plus closing cost and
estimated expenses of Fifteen Thousand And 00/ 100 Dollars ($ 15,000.00) for the acquisition of a water,
wastewater and electric easement for the City of Denton 1-35 relocation project (Total Costs
$ 1,615,000.00).
SECTION 5. The Owner has been provided with a copy of the Landowner’s Bill of Rights, and
Appraisal as contemplated by applicable state statute.
SECTION 6. If any section, article, paragraph, sentence, phrase, clause, or word in this
ordinance, or application thereof to any persons or circumstances, is held invalid or unconstitutional by a
court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
ordinance; the City Council declares that it would have ordained such remaining portion despite such
invalidity, and such remaining portion shall remain in full force and effect.
