HomeMy WebLinkAbout24-974ORDINANCE NO. 24-974 AN ORDINANCE OF THE CITY OF DENTON ESTABLISHING CLASSIFICATIONS AND POSITIONS IN THE DENTON FIRE DEPARTMENT; CREATING AND ELIMINATING CERTAIN POSITIONS; REPEALING ORDINANCE NO. 24-178 RELATING TO ESTABLISHING THE CLASSIFICATIONS AND PRESCRIBING THE NUMBER OF POSITIONS IN EACH CLASSIFICATION FOR THE DENTON FIRE DEPARTMENT; PROVIDING REPEALER, CUMULATIVE, AND SEVERABILITY CLAUSES; AND DECLARING AN EFFECTIVE DATE. WHEREAS, pursuant to Section 143.021, Texas Local Government Code, the City Council of the City of Denton, is required by ordinance to prescribe the number of positions in each classification for Fire Department personnel; and WHEREAS, on February 6, 2024, the City Council passed Ordinance No. 24-178 adopting and approving a schedule of Authorized Positions relating to classification of fire fighters; and WHEREAS, due to the continuing increased level of Fire services needed to serve the Denton community, as well as to ensure the Fire Department’s ability to provide mutual and automatic aid to other North Texas cities when needed, the Fire Chief has recommended that the City Council eliminate and create certain positions within the Fire Department, which will not result in an increase of the total number of classified positions within the Fire Department remaining the same; and WHEREAS, since the passage of Ordinance No. 24-178, the Fire Department has updated the titles and number of positions designated for certain classifications of Fire Department personnel, and have submitted the revisions to the City Council for review and approval based on the Department’s determination that these changes are in the Department’s best interest; and WHEREAS, the City Council has considered these updated classification titles and numbers and has found these changes to be in the City’s best interest and accordingly has determined that Ordinance No. 24-178 should be repealed and the following classification titles and total number of positions in the Fire Department should be adopted; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. Ordinance No. 24-178 is hereby repealed. SECTION 2. The City Council hereby adopts and approves the following civil service classifications of the Denton Fire Department and the number of positions in each classification is established as follows: (A) (B) (C) (D) (E) Assistant Fire Chief Battalion Chief – Operations Fire Marshal Community Risk Reduction Officer Fire Training Captain 2 9 1 1 1 Page 1 (F) (G) (H) EMS Captain Captain – Operations Deputy Fire Marshal III/Assistant Fire Marshal Fire Lieutenant Driver Deputy Fire Marshal II Deputy Fire Marshal I Emergency Management Program Manager Firefighter 1 31 2 6 63 1 7 I 101 (1) (J) (K) (M) W) (0) TOTAL: 227 SECTION 3. Per Ordinance 24-178, there existed the single civil service classification of Assistant Fire Chief/Fire Marshal. That single civil service classification is hereby eliminated and as noted in Part 2 of this ordinance, separated into two (2) civil service classifications: one (1) additional Assistant Fire Chief for a total of two (2), and one (1) Fire Marshal. SECTION 4. Per Ordinance 24-178, there existed two (2) separate civil service classifications of Assistant Fire Marshal and Deputy Fire Marshal III. Those separate civil service classifications are eliminated and as noted in Part 2 of this ordinance, there is hereby created a single civil service classification of Deputy Fire Marshal III/Assistant Fire Marshal with two (2) posrtlons. SECTION 5. The number of positions in the civil service classification of Deputy Fire Marshal II in Section 2 of this ordinance is a decrease of one (1) from the number in existence immediately before the effective date of this ordinance. SECTION 6. This ordinance shall be cumulative of all provisions of ordinances of the City of Denton, except where the provisions of the ordinance are in direct conflict with the provisions such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 7. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance, shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 8. This ordinance shall become effective upon it passage as provided for by law, except that the creation of the six (6) Fire Lieutenant positions and six (6) of the Driver positions in Part 2 of this ordinance shall become effective on June 1, 2024.
