AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZiNG TIU CITY
MANAGER TO EXECUTE AN AGREEMENT WITH THE U.S. DEPARTMENT OF
HOMELAND SECURITY CYBERSECURITY & INFRASTRUCTURE SECURITY AGENCY
TO CONDUCT A VALIDATED ARCHITECTURE DESIGN REVIEW ASSESSMENT TO
EVALUATE THE OPERATION TECHNOLOGY ENVRONMENT CYBERSECURITY
POSTURE: RATIFYPgG THE EXECUTION OF Tm CYBERSECURITY ASSESSMENTS
RULES OF ENGAGEMENT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the U.S. Department of Homeland Security Cybersecurity and Infrastructure
Security Agency (“CISA”) offers a program whereby local governments can receive a review of
operational technology at not cost to the local government; and
WHEREAS, the Denton Municipal Electric and Water Utilities note that a Validated
Architecture Design Review Assessment (“VADR”) would be beneficial to those respective
utilities;
WHEREAS, CISA requires an agreement detailing the arrangement to be provided (the
“VADR Agreement”); and
WHEREAS, the City Council finds that the VADR Agreement is acceptable and is in the
public interest; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS :
SECTION 1. The City Manager, or their designee, is hereby authorized to enter into an
agreement with the CISA, a copy of which is attached hereto and incorporated by reference herein.
SECTION 2. The City Manager, or their designee, is authorized to execute any additional
documents that might be required by the CIS A in order to effectuate the VADR.
SECTION 3. The City Council of the City of Denton, hereby expressly delegates the
authority to take any actions that may be required or permitted to be performed by the City of
Denton under this ordinance to the City Manager of the City of Denton, or their designee.
SECTION 4. The findings in the preamble of this ordinance are incorporated herein by
reference.
SECTION 5. This ordinance shall become effective immediately upon its passage and
approval.
SECTION 6. The City Council of the City of Denton hereby ratifies the Cybersecurity
Assessments Rules of Engagement, a copy of which is attached hereto and incorporated by
reference herein.
