AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF A SECOND AMENDMENT TO AN
ENGAGEMENT BETWEEN THE CITY OF DENTON AND BANOWSKY, P.C., AMENDING
THE ENGAGEMENT APPROVED BY THE CITY ATTORNEY ON AUGUST 8, 2022 IN THE
NOT-TO-EXCEED AMOUNT OF $49,500.00; AMENDED BY A FIRST AMENDEMENT
APPROVED BY THE CITY MANAGER i SAID SECOND AMENDMENT TO SATISFY
FrNAL INVOICE FOR LEGAL SERVICES RENDERED TO THE CITY OF DENTON;
PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN
EFFECTIVE DATE (FILE 8235 – PROVIDING FOR A SECOND AMENDMENT
EXPENDITURE AMOUNT NOT-TO-EXCEED $8,545.95, WITH THE TOTAL CONTRACT
AMOUNT NOT-TO-EXCEED $107,545.95).
WHEREAS, on August 8, 2024, the City Attorney awarded a contract to Banowksy, P.C., in
the amount of $49,500.00, for legal services relating to the Hickory Creek Road widening and
improvement project; and
WHEREAS, on May 14, 2024, the City Manager approved a first amendment to Banowsky,
P.C. in the amount of $49,500.00
WHEREAS, this procurement was undertaken as part of the City’s governmental function;
and
WHEREAS, the additional fees under the proposed second amendment are fair and
reasonable and are consistent with, and not higher than, the recommended practices and fees
applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The second amendment, increasing the amount of the contract between the
City and Banowsky, P.C., which is on file in the office of the Purchasing Agent, in the amount of
Eight Thousdand Five Hundred Forty Five and 95/1 00 ($8,545.95) Dollars, is hereby approved, and
the expenditure of funds therefor is hereby authorized in accordance with said amendment which
shall be effective upon the execution of the amendment referenced herein. The total contract amount
increases to $107,545.95 .
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
