HomeMy WebLinkAbout24-1626RESOLUTIONNO. 24-1626 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS PLACING A PROPOSAL ON THE SEPTEMBER 17, 2024 CITY COUNCIL PUBLIC MEETING AGENDA TO ADOPT A 2024 TAX RATE THAT W[LL EXCEED THE LOWER OF THE NO- NEW-REVENUE TAX RATE OR THE VOTER-APPROVAL TAX RATE; CALLING A PUBLIC HEAR[NG ON THE PROPOSED TAX RATE WHICH WILL RESULT IN AN INCREASE IN TAX REVENUE TO THE CITY FOR FISCAL YEAR 2024-25, TO BE HELD ON SEPTEMBER 10, 2024; CALLING A PUBLIC HEARING ON THE BUDGET FOR THE FISCAL YEAR 2024-2025 ANNUAL PROGRAM OF SERVICES OF THE CITY OF DENTON TO BE HELD ON SEPTEMBER 10, 2024; REQUIRING THE PUBLICATION AND POSTING OF NOTICES OF THE PUBLIC HEARINGS AND MEETINGS IN ACCORDANCE WITH THE LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council desires to adopt the Fiscal Year 2024-2025 Annual Program of Services (“Budget”) for the City of Denton, Texas; and WHEREAS, in order to adopt the Budget, the City Council must hold a public hearing on the Budget and provide notice of same in accordance with Article VIII “Budget” of the City Charter and other applicable law; and WHEREAS, the City Council desires to consider adopting a tax rate of $0.595420 per $ 100 valuation, which will exceed the lower of the no-new-revenue tax rate or voter-approval tax rate, in accordance with the requirements of the Texas Local Government Code Chapter 140 and Tax Code Chapter 26, as applicable; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES: SECTION 1. The findings set forth in the preamble of this Resolution are incorporated by reference into the body of this Resolution as if fully set forth herein. SECTION 2. The City Council desires to consider adopting a tax rate for the 2024 tax year of $0.595420 per $100 valuation that will exceed the lower of the no-new-revenue tax rate or the voter-approval tax rate. SECTION 3. The City Council hereby approves placing an item on the September 17, 2024, City Council public meeting agenda to vote on a proposed tax rate of $0.595420 per $100 valuation that will exceed the lower of the no-new-revenue rate or the voter approval tax rate. The meeting to vote on a proposed tax rate will not be held until notice of the meeting to vote on a proposed tax rate has been published in the Denton Record Chronicle , a newspaper having general circulation within the City, in the form of the attached Notice of Meeting to Vote on Tax Rate, which is made a part of this Resolution for all purposes. The City Manager or their designee is directed to post the attached Notice of Meeting to Vote on Tax Increase prominently on the City’s home page of the Internet website and shall request that the City’s public access television channel carry a 60-second notice of the meeting to vote on a proposed tax rate. SECTION 4. The City Council hereby calls a public hearing on the proposed tax rate to be held at City Hall at 215 East McKinney Street in Denton, Texas 76201 on September 10, 2024, at 6:30 p.m. The public hearing will not be held until after notice of the public hearing has been published in the Denton Record-Chronicle , a newspaper having general circulation within the City, in the form of the attached Notice of Public Hearing on Tax Increase, which is made a part of this Resolution for all purposes. The City Manager, or their designee, is hereby directed to publish said notice in accordance with this Resolution and in accordance with applicable law. The City Manager or their designee is also directed to post the attached Notice of Public Hearing on Tax Increase prominently on the home page of the City’s Internet website, and further, shall request that the City’s public access television channel carry a 60-second notice of the public meeting in the manner, at the times, and for the periods required by law. At the public hearing, the City Council will afford adequate opportunity for proponents and opponents of the proposed tax rate to present their views. SECTION 5. The City Council hereby calls a public hearing on the proposed Budget to be held at City Hall at 2 15 East McKinney Street in Denton, Texas 76201 on September 10, 2024, at 6:30 p.m. The public hearing will not be held until notice of the public hearing has been published in the Denton Record-Chronicle , a newspaper having general circulation within the City, in the form of the attached Notice of Public Hearing on Budget, which is made a part of this Resolution for all purposes. This notice shall be published not earlier than the 30th or later than the 10th day before the date of the public hearing. The City Manager, or their designee, is hereby directed to publish said notice in accordance with this Resolution and in accordance with Article VIII of the City Charter, Chapter 102 of the Texas Local Government Code and all other applicable law. The City Manager, or their designee, is also directed to post the attached Notice of Public Hearing on Budget prominently on the home page of the City’s Internet website and shall request that the City’s public access television channel carry a 60- second notice of the public hearing in the manner, at the times, and for the periods required by law. At the public hearing, the City Council will afford adequate opportunity for proponents and opponents of the proposed budget to present their views. SECTION 6. This Resolution shall become effective immediately upon its passage and approval at a regular meeting of the City Council of the City of Denton, Texas on this the 20th day of August, 2024, at which meeting a quorum was present and the meeting was held in accordance with the provisions of Tex. Gov’t Code §551.001, er seq . The City Secretary is hereby directed to record this Resolution and the vote on the proposal to place the item for adoption of a 2024 tax rate on the September 17, 2024, City Council agenda, and the hearing items on the September 10, 2024 agenda. The meeting will be held for the purpose of receiving community input on the Budget. A public meeting to vote on the Budget will be held on September 17, 2024 at 6:30pm at Denton City Hall 215 E. McKinney Street Denton, TX 76201. THIS BUDGET WILL RAISE MORE TOTAL PROPERTY TAXES THAN LAST YEAR’S BUDGET BY $16,841,936 OR 16.26:,,,'"’i AND OF THAT AMOUNT 87,210,937 IS TAX REVENUE TO BE RAISED FROM NEW PROPERTY ADDED TO THE TAX ROLL THIS YEAR. All interested citizens are encouraged to attend and express their views. If members of the public are not able to attend the hearings and meetings mentioned above in-person, members of the public will be able to participate in the meetings pursuant to the processes outlined at https://www.cityofdenton.com/242/Public-Meetings-Agendas Page 4 NOTICE OF PUBLIC HEARING ON TAX INCREASE A tax rate of $0.595420 per $100 valuation has been proposed for adoption by the governing body of the City of Denton. PROPOSED TAX RATE $0.595420 per $100 NO-NEW-REVENUE TAX RATE $0.531785 per $100 VOTER-APPROVAL TAX RATE $0.604748 per $100 The no-new-revenue rate is the tax rate for the 2024 tax year that will raise the same amount of property tax revenue for CITY OF DENTON from the same properties in both the 2023 and 2024 tax year. The voter-approval rate is the highest tax rate that CITY OF DENTON may adopt without holding an election to seek voter approval of the rate. The proposed tax rate is greater than the no-new-revenue tax rate. This means that CITY OF DENTON is proposing to increase property taxes for the 2024 tax year. A PUBLIC HEARrNG ON THE PROPOSED TAX RATE WILL BE HELD ON SEPTEMBER 10, 2024 AT 6:30 PM AT DENTON CITY HALL 215 E. MCKINNEY STREET, DENTON, TX 76201. A PUBLIC MEETING TO VOTE ON THE PROPOSED TAX RATE WILL BE HELD ON SEPTEMBER 17, 2024 AT 6:30 PM AT DENTON CITY HALL 215 E. MCKINNEY STREET, DENTON, TX 76201. The proposed tax rate is not greater than the voter-approval tax rate. As a result, CITY OF DENTON is not required to hold an election at which voters may accept or reject the proposed tax rate. However, you may express your support for or opposition to the proposed tax rate by contacting the members of the City of Denton at their offices or by attending the public hearing mentioned above. The 86th Texas Legislature modified the manner in which the voter-approval tax rate is calculated to limit the rate of growth of property taxes in the state.
