A RESOLUTION OF THE CITY OF DENTON RAT{FYING THE SUBMISSION OF AN
APPLICATiON PREVIOUSLY AUTHORIZED TO BE SUBMITTED IN RESOLUTION 23-
876 TO THE TEXAS DEPARTMENT OF TRANSPORTATION’S 2023 TRANSPORTATION
ALTERNATIVES SET-ASIDE (TA) PROGRAM IN THE TOTAL AMOUNT OF $13,714,880,
INCLUDING A LOCAL MATCH OF $2,742,976, FOR THE INSTALLATION OF 3.25 MILES
OF THE PECAN CREEK TRAIL SHARED USE PATH; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the Texas Department of Transportation (TXDOT) issued a call for projects
in December 2022 for communities to apply for funding assistance through the Transportation
Alternatives Set-Aside (TA) Program; and
WHEREAS, the TA funds may be used for the development of preliminary engineering
(plans, specifications, estimates, and environmental documentation) and construction of pedestrian
and/or bicycle infrastructure; and
WHEREAS, the TA funds require a local match, comprised of cash or Transportation
Development Credits (TDCs), if eligible. The City is responsible for all non-reimbursable costs
and 100% of overruns, if any, for TA funds; and
WHEREAS, on May 16, 2023, the City of Denton approved Resolution 23-876 authorizing
an application in the amount of $13,346,259 to be submitted to the TXDOT TA program; and
WHEREAS, on June 5, 2023, the City submitted application materials to the TXDOT TA
2023 Program in the amount of $13,714,880; and
WHEREAS, on October 26, 2023, TXDOT awarded the City of Denton $10,971,904 in
federal funding. The City’s required local match of $2,742,976 brings the project total to
$13,714.880. TxDOT requires an updated resolution matching the total project amount of
$ 13,714,880; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY RESOLVES :
SECTION 1. The recitations in the above preamble are incorporated herein as if fully set
forth in the body of this document.
SECTION 2. The application for the TXDOT 2023 TA Program is hereby ratified.
SECTiON 3. The City Manager, or designee, is designated, delegated, and authorized to
request grant funding under the TXDOT 2023 TA Program, including the submission of TXDOT’s
application, and act on behalf of the City of Denton in all matters related to the grant application,
receipt of funds, and any subsequent grant contracts, agreements, and grant projects that may
result
SECTION 4. The City of Denton is willing and able to enter into an agreement with
TXDOT, and to commit to its development, implementation, construction, maintenance,
management, and financing, and shall comply with the requirements of the grant.
SECTION 5. This resolution is effective immediately upon its passage.
The motion to approve this resolution was made by Joe Holland and seconded by Brian Beck, the
resolution was passed and approved by the following vote [4- 3] :
