HomeMy WebLinkAbout24-1975ORDINANCE NO. 24-1975 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A DEVELOPMENT AGREEMENT wrrH HL FUND II DENTON, L.P., A TEXAS LIMITED PARTNERSHIP, FOR THE DESIGN AND CONSTRUCTION OF PAVrNG PUBLIC IMPROVEMENTS; PROVIDING FOR THE EXPENDITURE OF FUNDS IN THE NOT-TO- EXCEED AMOUNT OF $643,107.00 THEREFOR; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, HL FUND II DENTON, L.P. (the “Developer”), is the owner of 37.17 acre commercial property located north of Jim Christal and east ofMasch Branch in the City of Denton, Texas (the “Property”); and WHEREAS, Developer is in the process of developing and improving the Property and in connection with the same, must design, construct, and install paving public improvements to service the Property the following improvements to Jim Christal Road: addition of two lanes, a median, storm sewer improvements, and sidewalk on the northern portion of said road from North Masch Branch Road and extending east approximately 1,264; and also designing, constructing and installing the following improvements to North N4asch Branch Road: addition of two lanes, storm sewer improvements, and sidewalks from Jim Christal Road and extending north for approximately 818 feet adjacent to the Property (the “Required Facilities”); and WHEREAS, as part of these Required Facilities, Developer is proposing widening Jim Christal Road from two (2) lanes to four (4) lanes from North Masch Branch Road to N. Western Boulevard to improve mobility and reduce congestion adjacent to the Property (the “Public Facilities”); and WHEREAS, the City has adopted the 2022 Mobility Plan (the “Mobility Plan”), comprising a thoroughfare plan map and associated thoroughfare standards, guiding the buildout of the city’s roadway, sidewalk, and on-street bicycle transportation network; and WHEREAS, the City, in accordance with its ordinances, wishes to participate in the cost of designing, constructing and installing said Public Facilities to provide increased mobility and align with the Mobility Plan and all necessary appurtenances thereto; and WHEREAS, the City Council has provided in the City budget for the appropriation of funds to be used for the purchase of the materials, equipment, supplies, or services approved and accepted herein; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The recitals contained in the preamble of this ordinance are hereby incorporated into the body of this ordinance are true and correct. SECTION 2. The City Manager, or her designated representative, is hereby authorized to execute the Development Agreement which is attached hereto and incorporated herein as Exhibit A SECTION 3. The City Council of the City of Denton hereby expressly delegates the authority to take any actions that may be required or permitted to be performed by the City of Denton under this ordinance to the City Manager of the City of Denton, or her designee. SECTION 4. The City Council hereby authorizes the expenditure of funds therefor in the amount and in accordance with the Development Agreement attached hereto and incorporated herein as Exhibit A. SECTION 5. This ordinance shall become effective immediately upon its passage and approval.
