HomeMy WebLinkAbout24-2526ORDINANCE NO. 24-2526 AN ORDINANCE APPROVING AN INSURANCE CLAIM PAYMENT FROM FM AFFILIATED INSURANCE COMPANY FOR DAMAGE TO PROPERTY LOCATED AT 1 100 SOUTH MAYHILL ROAD, AND AUTHORIZING THE CITY MANAGER, OR HER DESIGNEE, TO EXECUTE THE SAME; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on July 17,2024, a power screen (model Phoenix 3300) covered by the city’s property insurance policy in operation for beneficial reuse at the Pecan Creek Water Reclamation Plant was deemed a total loss when the equipment caught fire; and WHEREAS the parties have negotiated a payment in the amount of $492.609.17 to fully settle and satisfy all disputes related to City’s claim and insurance payment; and NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDA[NS: SECTION 1. The recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The City Council approves and authorizes an insurance claim payment in the amount of $492,609.17 for fire damage caused to the power screen (model Phoenix 3300) and authorizes the City Manager, or her designee, and the City’s attorneys, to act on the City’s behalf in approving and executing any and all documents necessary or appropriate to effectuate the terms for receipt of the insurance payment, and to take other actions necessary to complete related claim. SECTION 3. This Ordinance shall become effective immediately upon its passage and approval. The motion to approve this Ordinance was made by Brian Beck and seconded by Brandon Chase McGee.
