Home My WebLink About24-2569ORDINANCE NO. 24-2569 AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL CORPORATION, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT EXTENSION WITH EUROVLA ATLANTIC COAST LLC, DBA SUNMOUNT PAVING COMPANY, AS THE PRIMARY VENDOR, AND JAGOE-PUBLIC COMPANY, AS THE SECONDARY VENDOR, THROUGH JANUARY 5, 2026, TO CONTINUE THE SUPPLY AND INSTALLATION OF HOT MIX ASPHALT CONCRETE FOR THE STREETS DEPARTMENT; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (RFP 7486 – EXTENDING THE CONTRACTS WITH EUROVIA ATLANTIC COAST LLC, DBA SUNMOUNT PAVING COMPANY AND JAGOE- PUBLIC COMPANY, TO JANUARY 5, 2026). WHEREAS, Ordinance 20-2557 authorized a contract to Eurovia Atlantic Coast LLC. dba Sunmount Paving Company, as the primary vendor, and Jagoe-Public Company, as the secondary vendor for the supply and installation of hot mix asphalt concrete for the Streets Department, which is on file in the office of the Purchasing Agent; and WHEREAS, the staff having recommended, and the City Manager having recommended to the City Council that an extension to the existing purchasing authority approved by Ordinance 20-2557 be authorized between the City and Eurovia Atlantic Coast LLC, dba Sunmount Paving Company, as the primary vendor, and Jagoe-Public Company, as the secondary vendor, to expire on January 5, 2026; and WHEREAS, the City Council finds that the action taken herein is in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The authority to receive services from Eurovia Atlantic Coast LLC, dba Sunmount Paving Company, as the primary vendor, and Jagoe-Public Company, as the secondary vendor, authorized by Ordinance 20-2557, is hereby extended under File 7486 until January 5, 2026 SECTION 3. The City Council delegates the authority to the City Manager to take any actions that may be required or permitted to be performed by the City of Denton under File 7486 to the City Manager or their designee. SECTION 4: This ordinance shall become effective immediately upon its passage and approval. The motion to approve this ordinance was made by Gerard Hudspeth and seconded by Brandon Chase McGee. WHEREAS, the City deems it necessary to fbrther expand the goods/services provided by Contractor to the City; and WHEREAS, the original not-to-exceed amount may not be increased by more than 25.0% as provided in Texas Local Government Code Sec. 252.048; and NOW THEREFORE, the City and Contractor (hereafter collectively referred to as the “Parties”), in consideration of their mutual promises and covenants, as well as for other good and valuable considerations, do hereby AGREE to the following First Amendment, which amends the following terms and conditions of the said Agreement, to wit: This Amendment modifies the Agreement amount to provide an additional one (1) year term for additional services and materials to be provided in accordance with the terms of the Agreement. The term of the Agreement is extended until January 5, 2026.
