HomeMy WebLinkAbout24-2539ORDINANCE NO. 24-2539 AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE TEXAS PARKS AND WILDLIFE DEPARTMENT (TPWD) RECREATIONAL TRAILS GRANT PROGRAM 2025 FOR A REIMBURSEMENT GRANT IN THE AMOUNT OF $300,000 FOR THE CONSTRUCTION OF A TRAIL LOCATED ALONG SOUTH BONNIE BRAE STREET; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the TPWD opened the Recreational Trails 2025 grant application on November 1, 2024, that assists local units of government with the development of publicly accessible recreational trail projects throughout the State of Texas; and WHEREAS, the Recreational Trails Grant program is federally funded from a portion of federal gas taxes paid on fuel used in non-highway recreational vehicles; and WHEREAS, the Recreational Trails Grant Program has a grant ceiling of $300,000 for reimbursable non-motorized trail grants; and WHEREAS, the City of Denton as a home rule city possesses legal authority to apply, and is eligible to apply for the funds under the application criteria; and WHEREAS, the City has developed the necessary application materials and desires to make an application to the TPWD Recreational Trails Grant; and WHEREAS, TPWD Recreational Trails Grant Program 2025, is a reimbursement grant and sufficient funds are available to meet the applicants required cost share of the project; and WHEREAS, grant applications are due on February 3, 2025, and the adoption of a resolution, motion, or similar action authorizing the submittal of the grant application prior to the grant application deadline will be submitted with the grant materials; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The recitals above are hereby incorporated and made a part of this ordinance as if fully set out herein. SECTION 2. The City of Denton hereby certifies it is able to receive federal and state assistance under the TPWD Recreational Trails Grant Program 2025 . SECTION 3. The filing of an application, including all understandings and assurances contained therein, for the Recreational Trails Grant Program 2025 is hereby authorized. SECTION 4. The portion of the City of Denton trail system related to this Ordinance will be operated and maintained at the expense of the entity for public outdoor recreation use for a period of at least 20 years after project completion; SECTION 5. The City Manager, or designee, is the official representative, of the City of Denton to act in in connection with the application and to provide such additional information as may be required, and is designated, delegated, and authorized with the signature authority to request grant funding under the TPWD Recreational Trails Grant Program 2025, including the submission of TPWD ’s application, and act on behalf of the City of Denton in all matters related to the grant application, receipt of funds, and any subsequent authorization of grant contracts and amendments, and grant projects that may result. SECTION 6. Should the project be funded, then the City of Denton shall comply with the requirements of the TPWD and the State of Texas. SECTION 7. The City of Denton shall certify that the matching share for this program is readily available upon completion of the grant agreement. SECTION 8. The project funds and any project-funded equipment and facilities will be used solely for the purposes for which they are intended under the grant. SECTION 9. This ordinance is effective immediately upon its passage.
