AN ORDINANCEOF THECITY OF DENTON(“CITY”), A TEXASHOMERULE
MUNICIPAL CORPORATION,AUTHORIZING THE CITY MANAGER TO EXECUTE AN
INTERLOCAL AGREEMENTWITH WISE COUNTY CONCERNINGDELIVERY OF
SPECIFIEDTONNAGETOTHECITY’SLANDFILL BY WISECOUNTYAT A DISCOUNT
DISPOSALRATE (“INTERLOCALAGREEMENT”);AND PROVIDINGAN EFFECTIVEDATE
WHEREAS, theCity owns,operates,andmaintainsthe City of DentonECO-W. E. R. C.
S.Complex located at 1527SouthMayhill Road,Denton, Denton County, Texas 76208
("Landfill"); and
WHEREAS,the Landfill is operatedin accordancewith TCEQ Municipal Solid Waste
ManagementFacility PermitNo. MSW-1590B, asamended,issuedtothe City of Denton
pursuantto Texas Health & Safety CodeChapter 361; and
WHEREAS,theCity Councilof theCity of DentondesiresthattheCity of DentonLandfill
receivepredictable tonnagesof solid waste for both revenueand managementpurposes;and
WHEREAS, undertheInterlocal Agreement,Wise Countywill deliver aspecified annual
tonnageof solidwastetotheLandfill inexchangefor adiscounteddisposalfeeperton(“Discount
Disposal Rate”) and will make paymentbasedon the tonnagedelivered; and
WHEREAS, the Interlocal Agreement has a term of two (2) years,effective October 1,
2024, with no renewals or extensions; and
WHEREAS,the City of Dentonhasdeterminedthatthis Agreementis in the public
Interest.
NOW, THEREFORE,THE COUNCIL OFTHE CITY OFDENTON HEREBY ORDAINS:
SECTION 1. Thefindingsandrecitationscontainedin thepreambleof this Ordinance are
incorporatedhereinby reference.
SECTION2. TheCity Manageris herebyauthorizedto executetheInterlocal Agreement
with WiseCountyattachedheretoasExhibit “A“ andincorporatedfor all purposesfor delivery of
specified tonnage to the City’s landfill at a Discount Disposal Rate.
SECTION 3. Minor adjustmentsto the attachedInterlocal Agreement bythe City Manager
or their designeeareauthorized, suchasfilling in blanks and minor clarifications or corrections,
andanymodifications madeby City Council in the approval of this ordinance.
SECTION4. TheCity Manager,or their designee,isauthorizedto carryoutall dutiesand
obligationsto beperformedby the City underthe Interlocal Agreement,unlessotherwise
reservedin theInterlocal Agreementfor City Council approval.
SECTION5. ThisOrdinanceshall becomeeffective immediatelyuponits passageand
approval.
