HomeMy WebLinkAbout25-445ORDINANCE NO. 25-445 AN ORDINANCE OF THE CITY OF DENTON CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION TO ELECT CITY COUNCIL MEMBERS TO DISTRICTS 1, 2, 3, AND 4, AND THE SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING PROPOSED CHARTER AMENDMENTS TO THE REGISTERED VOTERS OF THE CITY OF DENTON. HELD ON MAY 3, 2025; DECLARING THAT NO CANDIDATE RECEIVED THE MAJORITY OF VOTES CAST FOR DISTRICT 3 IN THE GENERAL MUNICIPAL ELECTION AND THAT A RUNOFF ELECTION IS ORDERED TO BE HELD ON SATURDAY, JUNE 7, 2025; AUTHORIZING RUNOFF ELECTION DAY POLLING LOCATIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Denton, Texas (“City”) ordered a general and special municipal election to be held in the City on May 3, 2025 for the purpose of electing council members to Districts 1, 2, 3, and 4; and for the purpose of submitting proposed Charter amendments to the registered voters of the City of Denton replacing all instances of gendered language with non-gendered language, resolving conflicts with state law and modifying vague or unclear language, and increasing the term of municipal judge from two to four years; and WHEREAS, the official returns of the election have been opened, examined and canvassed; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Council finds and declares that the May 3, 2025 general municipal election was duly ordered for the purpose of electing council members to Districts 1, 2, 3, and 4; the May 3, 2025 special municipal election was duly ordered for the purpose of submitting proposed Charter amendments to the registered voters of the City of Denton replacing all instances of gendered language with non-gendered language, resolving conflicts with state law and modifying vague or unclear language, and increasing the term of municipal judge from two to four years; proper notice of said election was duly given and election officials appointed; the elections were duly held and the returns of the election officials have been delivered to the Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of the City of Denton. SECTION 2. The official returns of the election, herein incorporated by reference and attached as “Exhibit A”, having been opened, examined, and canvassed, and the Council hereby finds and declares the following candidates received a majority of the votes cast at the election in District 1, 2, and 4 and are declared to be elected to the City Council of the City of Denton as follows: FOR DISTRICT 1 : FOR DISTRICT 2: FOR DISTRICT 4: Vicki Byrd Brian Beck Joe Holland and the candidates shall assume the duties of office on the date they take the official oath of office SECTION 3. The official returns of the election officials having been opened, examined, and canvassed and the City Council officially finds and determines 8,695 votes were cast at this special election on the proposed Charter Amendment PROPOSITION A, qualified electors of the City, who voted at the election and that the votes cast for such propositions on the ballot for the election were as follows: EARLY/ABSENTEE VOTING: CITY OF DENTON PROPOSITION A Shall the City Charter be Amended to Rep}ace all Instances of Gendered Language with Non-Gendered Language? The official returns of the election officials having been opened, examined, and canvassed and the City Counci! officially finds and determines 8,586 votes were cast at this special election on the proposed Charter Amendment PROPOSITION C, qualified electors of the City, who voted at the election and that the votes cast for such propositions on the ballot for the election were as follows: EARLY/ABSENTEE VOTING: CITY OF DENTON PROPOSITION C Shall the Term of the Municipal Judge be Increased from 2 Years to 4 Years? The City Council finds and declares that no candidate received the majority of the votes cast for District 3 and that a runoff election is hereby ordered to be held on June 7, 2025. Candidates in the runoff election for District 3 will be Suzi Rumohr and Margie Ellis. SECTION 7. The polling places shall be designated by the Denton County Elections Administrator (the “Elections Administrator”) in accordance with the provisions of an election agreement and contract for election services (the “Agreement”) with the Elections Administrator. The locations of such polling places are set forth in Exhibit B, attached hereto. Exhibit B shall be modified to include additional or different election day polling places designated by the Elections Administrator and to conform to the Agreement. SECTION 8. Early voting shall be conducted by personal appearance at the locations, dates and times set forth in Exhibit C, attached hereto, and during the early voting period as required or permitted by law. Exhibit C shall be modified to include additional or different early voting locations designated by the Elections Administrator and to conform to the Agreement. SECTION 9. The Elections Administrator shall serve as the early voting clerk in accordance with the terms of the Agreement. The main early voting location for the election shall be at the following address: Denton County Elections Administrator 701 Kimberly Drive, Suite A100 Denton, Texas 76208 SECTION 11. The manner of holding such election and all questions pertaining thereto shall be governed by the Charter of the City of Denton, the Constitution and election laws of the State of Texas, the Voting Rights Act of 1965, as amended, insofar as they may be applicable. SECTION 12. If any section, subsection, paragraph, sentence, clause, phrase, or word in this Ordinance, or application thereof to any person or circumstance is held to be unconstitutional, such holding shall not affect the validity of the remaining portions of this Ordinance, the City Council of the City of Denton hereby declares that they would have enacted such remaining portions despite any such invalidity. SECTION 13. The City Council has found and determined the meeting at which this ordinance is considered is open to the public and that notice thereof was given in accordance with provisions of the Texas open meetings law, Texas Government Code Chapter 551, as amended, and that a quorum of the City Council was present. SECTION 14. This ordinance shall become effective immediately upon its passage and approval.
