RESOLUTION
WHEREAS, under the Home Rule Charter of the Czty of Denton,
Texas, the City Council as the governzng body of sazd Czty zs
vested with and may exerczse all powers granted a home rule city
by the Constitution of the State of Texas, as well as all power
of local self-government not prohzbited by the Constztutzon or
laws of the State of Texas, and
WHEREAS, thzs governzng body zs of the opznzon sazd Czty
and the other partzczpants zn the Texas }~unzczpal Power Pool can
effect investment and operating economzes by poolzng the use of
reserve electrzc capacity zn thezr respectzve systems and by
3oint development and/or constructzon and/or ownershzp and/or
operation of electrical generatzng and transmzsszon facilzties,
and fuel supplzes for these facilltzes, whzch would generate and
transmit electrzczty for thezr systems, that a non-membershzp,
non-profzt corporation should be formed to asszst the Pool zn
accomplishing these goals, that the provzdzng of such services,
faczlztzes and fuel would be to the best znterest of the City
and its inhabztants, and that a non-membershzp, non-profzt corpo-
ration organized for the aforementzoned purposes would be zn the
znterest of the general public, would promote soczal welfare and
would serve a publzc purpose
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DENTON, TEXAS, THAT
SECTION I
Messrs Ross A Segrest, Paul R Cunnzngham and J Rodney
Lee are hereby requested to form and create a non-membershzp,
non-profzt corporatzon under the Texas Non-Profzt Corporatzon
Act to be known as the "Texas Munzczpal Power Pool, Inc,", zn
order that such corporation may assist the Texas Munzczpal Power
Pool and its partzczpants zn effectzng znvestment and operating
economzes by poolzng the use of reserve electrzc capaczty zn thezr
respective systems and by joint development and/or construction
and/or ownership and/or operatzon of electrzcal generating and
transmisszon faczlities, and fuel supplzes for these faczlztles,
whzch will generate and transmit electrzczty for these systems
SECTION II
The non-membership, non-profzt corporatzon, when formed,
shall not be entitled to recezve any funds of the Czty razsed or
to be razsed by taxation, nor shall such corporatzon recezve any
other revenues from any presently exzstzng sources of the Czty
Provided, however, the City, either dzrectly or indirectly, may
purchase goods, zncludzng electrzczty, and servzces from the non-
profzt corporation

WHEREAS, on the 30th day of November, 1974, the Preszdent
declared a "major dzsaster" in the State of Texas under the pro-
vzszons of Publz¢ Law 288, 93rd Congress, and
WHEREAS, the City of Denton, is a publzc entzty withzn sazd
State,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
Czty of Denton that the Federal Disaster Asszstance Admznzstratlon
be and hereby is requested to arrange to have the appropriate
Federal Agency perform the followzng work
open, clean and repair existing draznage faczlzties,
open, clean and repazr exzstzng sanitary sewage facilztzes,
open, clean and repazr existzng water mains,
repamr and maintazn resulting damage to streets,
effect debrzs clearance of varzous publzc facilztzes, and
repair, reconstruct and replace damaged electrical distri-
bution facmlmties and mzscellaneous publzc works faczlltzes
Thzs body certifies that, to the best of zts knowledge and belief,
the requested work zs eligible under Publzc Law 288, 93rd Congress,
and agrees to (a) provide without cost to the United States all
lands, easements, and right-of-way necessary for accomplzshment of
the approved work, and (b) hold and save the Unzted States free
from damages due to the approved work and wzth respect to debris
removal shall indemnzfy the Federal Government agaznst any clazm
arising'from such removal

of Denton, State of Texas, as operatang ~der Artacle 44941-1
of Vernon's Cavil Statutes of the State of Texas, and
WHE~AS, saad Hospatal as pursuing an applacatlon for a
grant and loan for hospatal improvement, and
WHE~AS, saad Artacle 4494a-1, Section 5, authorizes a
resolutaon on the part of saad C~ty and County relative to the
pursuit of sa~d purpose.
NOW, THE~FO~, BE IT RESOLVED BY THE CITY CO~CIL OF THE
CITY OF DENTON, TEXAS'
That Flow Memorial Hospltal be and at is hereby authorized
md designated as the lawful agency to apply for, receive, and
expend any avaalable funds from the Federal or State Government
for Co~ty and Caty Hospltal purposes, and, not by lam~tat~on,
but speoifacally, to apply for a Federal grant through the Depart-
ment of Health, education and Welfare in the sum of $367,212.00
and for a loan from the Federal Government through the Department
of Health, Educatlon and Welfare in the sum of $293,770.00.
