AN ORDINANCE OF THE CITY OF DENTON ORDERING A SPECIAL ELECTION FOR
FILLING A VACANCY IN DISTRICT 1 FOR THE UNEXPIRED TERM ENDING IN MAY
2027, TO BE HELD ON NOVEMBER 3, 2026, AND IF REQUIRED, A RUNOFF ELECTION
TO BE HELD ON DECEMBER 12, 2026; PRESCRIBING THE TIME, MANNER, AND
CONDUCT OF THE ELECTION IN ACCORDANCE WITH A JOINT ELECTION
AGREEMENT AND CONTRACT FOR ELECTION SERVICES WITH THE ELECTIONS
ADMINISTRATOR OF DENTON COUNTY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Article II, Section 2.01(a) of the Denton City Charter provides that the city
council shall have seven (7) members, six (6) councilpersons and a mayor. Each councilperson
shall be elected to and occupy a place on the council, such places being numbered one (1), two (2),
three (3), four (4), five (5) and six (6). The mayor's position on the council shall be place seven
(7); and
WHEREAS, on July 30, 2026, Council Member Jordan Villarreal submitted his resignation
as a member of the Council District 1 to become effective on September 1, 2026; and
WHEREAS. the City Council received the resignation of Council Member Jordan
Villarreal on the day it was submitted; and
WHEREAS, Section 201.023 of the Texas Election Code states that if a Council Member
submits a resignation, whether to be effective immediately or at a future date, a vacancy occurs on
the date the resignation is accepted by the appropriate authority or on the eighth day after the date
of its receipt by the authority, whichever is earlier; and
WHEREAS, the City Council accepted the resignation on August 5, 2026; and
WHEREAS, Section 201.051(a) of the Texas Election Code requires a special election to
fill a vacancy in office be ordered as soon as practicable after the vacancy occurs; and
WHEREAS, District 1 is vacated and due for a special election to fill the unexpired term
ending in May 2027 of said District 1 to be held in accordance with the Denton City Charter on a
uniform election date as defined in the Texas Election Code. NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
true and correct and are hereby incorporated into the body of this ordinance by reference.
SECTION 2. A special municipal election is ordered to be held in the City of Denton,
Texas on Tuesday, November 3, 2026, such date being a uniform election date as defined in Texas
Election Code §41.001 for the purpose of electing a Council Member for Districts I for the
unexpired term ending in May 2027. In the event a runoff is required, the runoff election shall be
held on Saturday, December 12, 2026.
SECTION 3. District 1 is declared vacant. The first day to file for a Place on the special
election ballot is August 5, 2026. The deadline to file for a Place on the special election ballot is
August 20, 2026, at 6:00 PM.
SECTION 4. The polling places shall be designated by the Denton County Elections
Administrator (the "Elections Administrator") in accordance with the provisions of a joint election
agreement and contract for election services (the "Agreement") with the Elections Administrator.
SECTION 5. Early voting shall be conducted by personal appearance at the locations, dates
and times designated by the Elections Administrator in accordance with the provisions of the
Agreement with the Elections Administrator, and during the early voting period as required or
permitted by law.
SECTION 6. The most accurate information on election day and early voting locations and
voting times can be found or obtained by visiting the Denton County webpage noted below or
contacting said County as noted:

SECTION 7. The Elections Administrator shall serve as the early voting clerk in
accordance with the terms of the Agreement. The main early voting location for the election shall
be at the following address:

SECTION 8. Applications for early voting by mail must be received no later than the close
of regular business on October 23, 2026. Applications for early voting by mail must be submitted

SECTION 9. The manner of holding such election and all questions pertaining thereto shall
be governed by the election laws of the State of Texas.
SECTION 10. This ordinance shall become effective immediately upon its passage and
approval.

ORDENANZA DE LA CIUDAD DE DENTON QUE ORDENA UNAS ELECCION ESPECIAL
PARA OCUPAR UNA VACANTE EN EL DISTRITO 1 POR EL PERIODO INCONCLUSO QUE
FINALIZA EN MAYO DE 2027, QUE SE CELEBRARAN EL 3 DE NOVIEMBRE DE 2026, Y
EN CASO DE SER NECESARIO, UNA ELECCION DE SEGUNDA VUELTA QUE SE
CELEBRARA EL 12 DE DICIEMBRE DE 2026; QUE PRESCRIBE EL HORARIO, LA
MODALIDAD Y LA EJCUCI6N DE LA ELECCION, DE CONFORMIDAD CON UN
ACUERDO PARA ELECCIONES CONJUNTAS Y UN CONTRATO DE SERVICIOS
ELECTORALES CON EL ADMINISTRADOR ELECTORAL DEL CONDADO DE DENTON;
Y QUE FACILITA UNA FECHA DE ENTRADA EN VIGOR.
POR CUANTO, el articulo II de la secci6n 2.01(a) de los Estatutos de la Ciudad de Denton
dispone que el Concejo Municipal contard con siete (7) miembros, seis (6) concejales y un alcalde.
Cada concejal se elegird y ocupard un lugar en el Concejo, siendo dichos lugares numerados como
uno (1), dos (2), tres (3), cuatro (4), cinco (5) y seis (6). La posici6n del alcalde en el Concejo sera el
lugar siete (7); y
POR CUANTO, el 30 de julio de 2026, el concejal Jordan Villareal present6 su renuncia como
miembro del Distrito 1 del Concejo para que entrara en vigor el 1 de septiembre de 2026; y
POR CUANTO, el Concejo Municipal recibi6 la renuncia de concejale Jordan Villareal en ]a
fecha en se present6; y
POR CUANTO, la secci6n 201.023 del C6digo Electoral de Texas establece que si un
concejal presenta una renuncia, ya sea para que entre en vigor de inmediato o en una fecha posterior,
se produce una vacante en la fecha en que se acepta ]a renuncia por parte de la autoridad
correspondiente o en el octavo dia despues de la fecha de su recepci6n por la autoridad, to que suceda
primero; y
POR CUANTO, el Concejo Municipal acept6 ]a renuncia de concejale Jordan Villareal el 5
de agosto de 2026; y
POR CUANTO, la secci6n 201.051(a) del C6digo Electoral de Texas exige que se ordenen
unas elecciones especiales para ocupar una vacante en el cargo tan pronto como sea posible despues
de que produzca la vacante; y
POR CUANTO, el Distrito 1 estd vacante y se prevd una eleccion especial para ocupar el
periodo inconcluso que finaliza en mayo de 2027 de dicho Distrito 1 , que se celebrard de conformidad
con los Estatutos de la Ciudad de Denton en una fecha de elecciones unifon-nes, segun se define en el
C6digo Electoral de Texas. POR CONSIGUIENTE,
EL CONCEJO DE LA CIUDAD DE DENTON DECRETA LO SIGUIENTE:
SECCION 1. Las constataciones y declaraciones que se incluyen en el predmbulo de la
presente Ordenanza son veraces y correctas, y se incorporan de esta manera al cueipo de la presente
Ordenanza a modo de referencia.

SECCION 2. Se ordena la celebracion de una eleccion municipal especial en la Ciudad de
Denton (Texas) el dia marten 3 de noviembre de 2026, siendo dicha fecha una de elecciones
uniformes, como se define en la seccion [§] 41.001 del Codigo Electoral de Texas, con el fin de elegir
al concejale del distrito 1 para el periodo inconcluso que finaliza en mayo de 2027. En caso de que
sea necesaria una segunda vuelta, la eleccion de segunda vuelta se celebrary el dia sybado 12 de
diciembre de 2026.
SECC16N 4. Se declara vacante el Distrito 1. El primer dia para presentar la candidatura a
un lugar en la boleta de votacion de las elecciones generales o especiales es el 5 de agosto de 2026.
La fecha limite para presentar la candidatura a un lugar en la boleta de votacion de las eleccion
especial es el 20 de agosto de 2026 a las 6:00 p. m.
SECCION 5. Los lugares de votacion seran designados por el Administrador Electoral del
Condado de Denton (el "Administrador Electoral'), de conformidad con las disposiciones de un
acuerdo de elecciones conjuntas y un contrato de servicios electorales (el "Acuerdo") con el
Administrador Electoral.
SECCION 6. La votacion anticipada se llevary a cabo mediante comparecencia personal en
las ubicaciones, fechas y horarios designados por el Administrador Electoral, de conformidad con las
disposiciones del Acuerdo con el Administrador Electoral, y en el transcurso del periodo de votacion
anticipada segun to exija o permita la ley.

SECCION 8. El Administrador Electoral actuary como secretario de votacion anticipada, de
conformidad con los t6rminos del Acuerdo. La ubicacion principal de votacion anticipada para la

SECC16N 9. Las solicitudes de votacion anticipada por correspondencia deben recibirse a

SECCI6N 10. La modalidad de celebraci6n de dicha eleccion y todas las cuestiones al
respecto se regiran por ]as leyes electorales del estado de Texas.
SECCI6N I I. La presente Ordenanza entrara en vigor inmediatamente despu6s de su
promulgaci6n y aprobaci6n.
