SUBJECT
Consider adoption of an ordinance of the City of Denton granting the Denton Festival Foundation
Inc. a noise exception for the Denton Arts and Jazz Festival on Friday, September 11, 2026, from
3:00 p.m. to 11:00 p.m., Saturday, September 12, 2026, from 10:00 a.m. to 11:00 p.m., and Sunday,
September 13, 2026, from 11:00 a.m. to 9:00 p.m. at the North Texas Fairgrounds in Denton, Texas;
and providing an effective date.
BACKGROUND
The 43rd Annual Denton Arts and Jazz Festival is organized by the Denton Festival Foundation,
Inc. a nonprofit 501(c)(3) organization, which serves to showcase professional and amateur
musicians, artists, and performers.
For years, this free festival has featured over 2,700 performers, local and statewide vendors,
children’s activities, art exhibits, 250 booths, and seven stages with various entertainers at
Quakertown Park. Due to budgetary adjustments, the festival has made modifications to the event
this year, including, but not limited to, relocating the event to the North Texas Fairgrounds.
The Denton Festival Foundation, Inc, requests an exception to the noise ordinance with respect to
sound levels exceeding seventy (70) dBA and hours of operation on Friday, September 11, 2026,
from 3:00 p.m. to 11:00 p.m., Saturday, September 12, 2026, from 10:00 a.m. to 11:00 p.m., and
Sunday, September 13, 2026, from 11:00 a.m. to 9:00 p.m. at the North Texas Fairgrounds.
RECOMMENDATION
Staff recommends approval.

On April 9, 2019, City Council approved an exception to the noise ordinance for the Denton Arts
and Jazz Festival under Ordinance 19-689.
On September 14, 2021, City Council approved an exception to the noise ordinance for the Denton
Arts and Jazz Festival under Ordinance 21-1755.

Denton Arts and Jazz Festival under Ordinance 22-1492.
On August 19, 2025, City Council approved a three-year exception to the noise ordinance for the
