Home My WebLink About26-0570ORDINANCE NO 26-0570 AN ORDINANCE OF THE CITY OF DENTON APPROVING AN AMENDMENT TO THE EXISTING RATES, FEES, AND CHARGES FOR CITY -OWNED PROPERTY AND FACILITIES UPON DENTON ENTERPRISE AIRPORT; REPEALING ORDINANCE NUMBER 25-164 AND SUPERSEDING PRIOR AIRPORT FEE SCHEDULES; PROVIDING FOR SEVERABILITY, AND DECLARING AN EFFECTIVE DATE. WHEREAS, Denton Enterprise Airport operates under the guidance of the Federal Aviation Administration ("FAA") and the FAA recommends airports establish rates and fees associated with the use of airport land; and WHEREAS, in accordance with City Code, any fee for the use of City property must be adopted by City Council; and WHEREAS, the City Council finds that the fees imposed are in the public interest; and WHEREAS, the amended fees were presented at the meeting of the Airport Advisory Board on September 9, 2026; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The rates, fees, and charges for property, facilities, and services upon Denton Enterprise Airport shall be established as indicated in Exhibit A, incorporated in its entirety as if set out fully herein. SECTION 3. Ordinance Number 25-164 is hereby repealed, and all other prior conflicting Denton Enterprise Airport fee schedules are hereby superseded and repealed, but only insofar as the portion of such prior ordinances shall be in conflict with the provisions of this ordinance; and as to all other sections of the ordinance not in direct conflict herewith, this ordinance shall be and is hereby made cumulative except as to such prior ordinances or portions thereof as are expressly repealed hereby. SECTION 4. The Airport rates, fees, and charges shall be updated from time to time to ensure Airport property and facilities are producing fair market value and the airport is recovering revenue sufficient to meet operational and capital expenses. SECTION 5. The provisions of this ordinance are severable, and the invalidity of any phrase or part of this ordinance shall not affect the validity or effectiveness of the remainder of this ordinance. If any section, subsection, paragraph, sentence, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portion of this ordinance, and City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION 6. This ordinance, upon its passage and approval, shall become effective on October 1, 2026.
