Z���- AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO EXPAND THE SCOPE OF ACTIVITIES AND EXTEND THE TERM OF A RIGHT OF ENTRY AND POSSESSION DATED MARCH 3, 200% AND EXTENDED ON MAY 59 200% AND SUBSEQUENTLY EXTENDED ON JUKE 231 20099 IN FAVOR OF THE DENTON COUNTY TRANSPORTATION AUTHORITY (DCTA) AND AUTHORIZING DCTA TO ENTER UPON AND TAKE POSSESSION OF CERTAIN REAL PROPERTY OF THE CITY OF DENTON FOR THE PURPOSE OF PERFORMING ACTIVITY AS DESCRIBED IN ATTACHMENT "A" HERETO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Denton, Texas is a Home -Rule City and a Municipal Corporation (hereafter "Grantor"), and claims an interest in and to the following described tract of land: BEING all that certain lot, tract, or parcel of land described in that certain Quitclaim Deed from Missouri Pacific Railroad Company to the City of Denton, Texas dated August 9, 1993, and filed on August 24, 1993, as Clerk No. 93-R0058485 in the Real Property Records of Denton County, Texas; and also being that same property described in that certain Correction Quitclaim Deed, dated June 1, 2001 and filed for record in the Real Property Records of Denton County, Texas as Volume 4857, Page 02021 (hereafter the "Property"). WHEREAS, the Denton County Transportation Authority (hereafter "DCTA") expects to acquire an easement in the Property from the City of Denton, Texas for the purpose of constructing, operating and maintaining DCTA's passenger rail line (the "Project") for approximately eight miles, extending southward through the City of Denton, and much of which easement tract lies within the City of Denton, Texas; and WHEREAS, the City of Denton, Texas expects to grant unto DCTA a perpetual easement upon reaching acceptable terms of agreement, in order that DCTA can immediately commence preliminary construction activities on the above -referenced Proj ect; and WHEREAS, DCTA needs immediate possession of the Property in order to prepare the Property for DCTA construction activities, pending final negotiation of the terms of the easement with the City of Denton and the Dallas Area Rapid Transit; and WHEREAS, both the City of Denton and DCTA recognize the urgency of commencing construction on the Project as soon as is reasonably possible; and WHEREAS, on March 3, 2009 the City Council adopted Ordinance No. 2009-059 authorizing the execution of a Right of Entry and Possession to DCTA; and WHEREAS, on May 5, 2009 the City Council adopted Ordinance No. 2009--118 extending the expiration of the Right of Entry and Possession for a period of 30 days from the date of expiration set forth in Ordinance No. 2009-059; and sAour documentsl0rdinances1091dcta roe rail line amended 090109.doc WHEREAS, on June 23, 2009 the City Council adopted Ordinance No. 2009-149 expanding the scope of activities and extending the terra of the said Right of Entry and Possession until September 8, 2009; and WHEREAS, The City Council deems it to be in the best interest of the City to execute an amendment to expand the scope of activities and extend the term of the said Right of Entry and Possession in favor of DCTA through September 15, 2009; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The City Manager, or his designee, is hereby authorized and directed to execute a Right of Entry and Possession for the above described property in favor of DCTA. A copy of the said Right of Entry and Possession is attached hereto as Attachment "A" and incorporated herein for all purposes. SECTION 2. The authority granted DCTA pursuant to this Ordinance shall* be conditioned upon DCTA's compliance with all applicable federal, state or local laws and regulations including, but not limited to, any and all City of Denton mandated standard requirements, procedures and processes for obtaining permits prior to the commencement of any activity authorized herein. Failure to comply with all such requirements, including the obtaining of required permits, prior to the commencement of such activities shall cause the immediate suspension of all authority granted DCTA pursuant to this ordinance. SECTION 3. The authority granted DCTA pursuant to this Ordinance shall extend through September 15, 2009 after which date all authority granted herein shall cease and this Ordinance shall be of no further force and effect. SECTION 4. This Ordinance shall become effective immediately upon its passage and approval. Page I of 3 This grant of right of entry and possession is conditioned upon the following: 1. DCTA may perform pre -construction surveying upon the Property, such as activities of survey crews and pick-up trucks; and 2. DCTA may install erosion control, such as erection of silt fences and the installation of construction entrances; and 3. DCTA may conduct limited clearing and grubbing on the Property, such as cutting and mulching vegetation, and removing stumps, roots, and debris. Any clearing and grubbing activity scheduled on the Property shall be subject to the following: a. A plan for the work shall be provided identifying locations, means and methods, a listing of contractors with contact information along with a schedule of who, when, and where the work will be done. b. Communication with City of Denton personnel that will be inspecting or monitoring this work Grantee or Grantee's agents shall initiate notification through Alberto Lopez with Denton Water Utilities at (940) 391-8622. c. DCTA will provide a point of contact with the DCTA for communication, coordination and claims resolution. d. Clearing and grubbing of trees within the 20 feet of the eastern boundary of the Property shall be limited to chain saws and stump grinders to avoid disturbance to adj acent underground utilities. 4. DCTA may conduct pot holing of utilities through coordination with the Denton Water Utilities subject to the following: a. A plan for the work shall be provided to City identifying locations, means and methods, a listing of contractors With contact information along with a schedule of who, when, and where the work will be done. b. Communication with City of Denton personnel that will be inspecting or monitoring this work. Grantee or Grantee's agents shall initiate notification through Alberto Lopez with Denton Water Utilities at (940) 391-8622. c. DCTA will provide a point of contact with the DCTA for communication, coordination and claims resolution. 5. DCTA may perform construction activities in Phase I and Phase II of the corridor, Hickory Street to Shady Oaks subject to the conditions listed in Items 5, 7, and S below. The limits of Phase I is demonstrated in Exhibit 1 A and the limits of Phase II is demonstrated in Exhibit Page 2 of 3 1B. DCTA may perform construction activities as outlined in the Denton Area 3 Month Look Ahead, demonstrated in Exhibit 2 (Phase I and Phase II). 5. The attached Exhibit 3 shows the current outstanding water, sewer, drainage and transportation issues related to Phase 1 of the project. The items highlighted in Exhibit 3 are issues that the City has determined must be resolved prior to any construction beyond limited clearing and grubbing, potholing, and erosion control as outlined above. All revisions must be submitted to, and approved by, the Development Review Committee. 7. The attached Exhibit 4 shows the current outstanding water, sewer, drainage and transportation issues related to Phase 2 of the project. The items highlighted in Exhibit 4 are issues that the City has determined must be resolved prior to any construction beyond limited clearing and grubbing, potholing, and erosion control as outlined above. All revisions must be submitted to, and approved by, the Development Review Committee. 8. DCTA must, submit performance and payment bonds, and pay 2.5 percent inspection fee equal to the value of all public improvements prior to the preconstruction meeting with the Public Works Inspection Department. PS Arora, Development Review Committee Engineering Administrator should be contacted at (940) 349-7189 prior to initiating any construction activities. This Right of Entry and Possession shall extend to DCTA, its employees and its contractors. This Right of Entry and Possession shall be valid through September 15, 2009, as evidenced by the signature of its City Manager; thereafter it shall terminate and be of no further force and effect. Clearly label existing and proposed water lines on the Crossing Gate Layout sheets, and confirm no conflicts with crossing gates. 3. Sheets T-06 (Typical Signal Foundation Installation), T-08 (Typical Bracket Mast Signal Foundation Installation), T-11 (Typical Crossing Gate Foundation Installation), T-13 (Typical Cantilever Foundation Installation 12 to 26 Foot Main Arm), and T-14 and T-15 (Typical Cantilever Foundation Installation 36 to 44 Foot Main Arm) show general foundation requirements with unknown impacts on City utilities. Type II rainfall distribution shall be used for all hydrologic models. 2. Provide input and output printouts of all HEC-RAS models. 3. Provide summary input and output of all hydrologic modeling. 4. 100-year water surface elevations for the bridges as printed on the construction plans should match cross section at the upstream face of the bridge. 5. Provide Floodway models for Revised Existing (Pre -Project) and Post -Project conditions for PEC-4. 5. Additional comments may be issued upon receipt and review of requested data and models. 7. Provide runoff and storm pipe calculations for all culvert profiles. 8. There are multiple culverts that are not profiled and utility crossings are not shown on storm drain profiles along street intersections. 9. There appears that there are existing culverts that cross the existing rail that are not shown on plan and not addressed. 10. There is general concern over numerous flat longitudinal slopes for both proposed earthen and concrete swales along the DCTA ROW. Morse Creek 11. See general comments. 12. Lag times, Runoff Coefficients, etc. could not be found in Appendix B 13. Stream profile for Morse Creek does not include the Pedestrian Bridge. 14. 100-year water surface elevations for the bridges as printed on the construction plans should match upstream face of the bridge. 15. 100-year water surface elevation (WSEQ at the upstream face of the railroad bridge is 616.27 under proposed conditions which is less than 12 inches from the low chord elevation of 616.86 and does not meet City of Denton clearance requirements between too -year WSEL and Low Chord. 16. Two cross section plots were found in the document for 1210 and 1250. Cannot determine which cross section is correct. 17. Show both sides of the DCTA ROW line to determine if proposed grading is contained within the ROW. Stream PEC-4 18. See general comments 19. A grading easement from private property needs to be acquired prior to construction. Provide recorded documentation of this easement. Transportation General Comments: 1. City Traffic Signal Specifications and Schematics are not attached with this submittal. 2. The applicant is required to submit a written agreement for review by the City with regard to access rights by DCTA to City signal controllers/cabinets. 3. The applicant is required to submit a written agreement for review by the City with regard to maintenance of DCTA equipment located inside COD signal controllers/cabinets. 4. The applicant is required to submit a written agreement for review by the City with regard to maintenance of rail and bike path signage. 5. The applicant is required to submit a written agreement for review by the City with regard to maintenance of street and bike path pavement markings. 6. The applicant is required to discuss with the City with regard to right-of-way acquisition for the proposed signal equipment at the intersection of Bell Avenue and Sycamore Street (in private property). 7. The applicant is required to discuss with the City with regard to pre-emption panel design within City signal cabinets. 8. The applicant is required to submit a written agreement for review by the City with regard to maintenance of DCTA electrical conduit within City ROW. 9. The applicant is required to discuss with the City with regard to acquisition of temporary construction and slope easements. 10. The applicant is required to discuss with the City with regard to proposed gate locations conflicting with future pavement widening of unimproved streets and/or sidewalks. 11. The applicant is required to discuss with the City with regard to all in -kind replacement of existing sidewalk that does not comply with COD width standards. 12. The applicant is required to discuss with the City with regard to extension of rail pads to accommodate future pavement widening of unimproved streets and/or sidewalks. 13. The applicant is required to discuss with the City with regard to placement of future trailblazing signs for the DCTA.rail stations upon extension of Medpark Station and TXDOT 1-35E improvements. 14. ADA ramps are not required for sidewalk connections to the proposed bike path. 15. All City ADA ramps within public ROW is required to be COD Type 1 ramps. 16. Include a note on all "SIGNING AND STRIPING PLAN" sheets to state "City of Denton specifications shall take precedence where conflicts between plans and attached City of Denton specifications occur. 17. on all Signage and Striping plans, please provide additional information as to what type of existing signs are proposed to be removed/relocated. Sheet C-680 (DUNCAN STREET INTERSECTION LAYOUT): 1. The Kerley Street right turn lane onto Duncan Street does not appear to allow larger vehicles to avoid encroachment into the opposite traffic lane. The City will require either a compound radius of a right turn configuration at Old US Hwy 77/Shady Shore Road (see sheet C-664). Sheet C-682 (MORSE STEET INTERSECTION LAYOUT): 1. Install two barrier free ramps at the northwest corner of Robertson/Morse Streets. 2. Adjust the barrier free ramp on the northeast corner of Robertson/Morse Streets to line up with the ramp located across the street on Robertson. 3. Provide surmountable curb and traffic -worthy pavement to allow large vehicles heading westbound along Morse Street to make the right -turn onto Robertson Street. Sheet C-684 (ROBERTSON STREET INTERSECTION LAYOUT): 1. The City will require a compound curve at the northwest corner ofJackson/Robertson Streets to allow larger vehicles traveling southbound along Jackson Street to make the right -turn onto Robertson Street. 2. The City will require that the northern bike path ramp onto Robertson Street be squared off at the street in lieu of a 5-foot radius connection. Sheet C-686 (EAST PRAIRIE STREET INTERSECTION LAYOUT): 1. Show the existing easement for the bike path on the north side of East Prairie Street where it encroaches into private property. Sheet C-688 (SYCAMORE STREET INTERSECTION LAYOUT): 1. Provide additional information on what the bike path ramp on the north side of Sycamore Street is connecting to. Sheet C-757 (SHADY OAKS STREET SIGNING AND STRIPING PLAN): 1. This sheet was not included with this submittal. Sheet C-759 (MORSE STREET SIGNING AND STRIPING PLAN): 1. Stop bars are required to be 18-feet from the street intersection. 2. Remove the crosswalk at Robertson Street. 3. Relocate the crosswalk at Morse Street to the west side of Roberson Street. Sheet C-760 (ROBERTSON STREET SIGNING AND STRIPING PLAN): 1. The applicant is required to discuss with the City with regard to why the proposed rail gate arms are blocking the bike path crosswalk. Sheet C-843 (BELL AVE AT PRAIRIE STREET TRAFFIC SIGNAL DESIGN): 1. Insert a note stating "This signal to be removed only upon approval of the Prairie Street closure by the City of Denton". Facamantc- The following easements need to be acquired prior to construction. Provide necessary recorded documentation to the City prior to construction. Slope Easements: 1. Morse Street: North side of roadway, on east side of DCTA ROW Temporary Construction Easements: I. Morse Street: South side of roadway, on west side of DCTA ROW 2. Robertson Street: North side of roadway, on east side of DCTA ROW Grading Easements: 1. PEC-4 Bridge 2. The remaining bridges did not show both sides of the DCTA ROW to verify if additional easements are needed. Sta. 1921+15: The proposed construction appears to possibly be in conflict with the existing 12" water main. Provide an additional cross section for this location, showing existing location and depth of this main so that conflicts can be identified and the improvements redesigned as necessary. 5. Sta 1939: Bike Path Profile shows the flowlines of the proposed 2-24" and the 1.8" to each be several feet below existing grade. Pothole RWL in this area to confirm adequate vertical clearance. 5. From Sta 1939 thru 1942, the proposed concrete flume appears to be possibly in conflict with the existing 30" raw water line. In these cross -sections, show existing location and depth of this line so that conflicts can be identified and improvements redesigned as necessary. Sewer 1. Clearly label existing and proposed sewer lines on the Electrical Service for CIL (Central Instrument Location) sheets, and confirm no conflicts with CIL's. 2. Clearly label existing and proposed sewer lines on the Crossing Gate Layout sheets, and confirm no conflicts with crossing gates. 3. The applicant is required to discuss with the City with regard to discontinuity of the bike path at Brinker Road along with the alignment of the future bike path crossing of Brinker Road. Sheet C-755A (BRINKER ROAD SIGNING AND STRIPING PLAN): 1. Revise title of the plan to state "Signs and striping plan for proposed signal when installed". 2. Remove all left turn pavement markings. 3. Move the right turn pavement marking to where the taper lane and the storage lane meet. Sheet C-7556 (LOOP 288 SIGNING AND STRIPING PLAN): 1. Provide information on why pavement markings are called out on the Loop 288 left turn lane. This should already be included with the Loop 288 widening project. 2. Show abutments for future pedestrian bridge and how bike path will connect to the bridge. 3. Any construction within TXDOT ROW will require a TXDOT Permit. Sheet C-756 (COLORADO BLVD SIGNING AND STRIPING PLAN): 1. Relocate the R3-7R right turn sign to the midpoint of the taper lane. Easements: The following easements need to be acquired prior to construction. Pro►►ide necessary recorded documentation to the City prior to construction. Temporary construction Easements: 1.
