AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING CHANGE FROM THE PLANNED DEVELOPMENT 139 (PD-139) AND A NEIGHBORHOOD RESIDENTIAL MIXED USE (NRMU) ZONING DISTRICT CLASSIFICATIONS AND USE DESIGNATIONS TO A COMMUNITY MIXED USE GENERAL (CM-G) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION CONTAINING 88.54 ACRES OF LAND LOCATED AT THE SOUTHWEST CORNER OF VINTAGE BOULEVARD AND BONNIE BRAE STREET, IN THE CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF, SEVERABILITY AND AN EFFECTIVE DATE. (Z08-0007 and Z08-001 1) WHEREAS, City of Denton, Facilities Management, has applied for a change in zoning for approximately 88.54 acres of land legally described in Exhibit A, attached hereto and incorporated herein by reference (hereinafter, the "Property") from the Planned Development 139 (PD-139) and a Neighborhood Residential Mixed Use (NRMU) zoning district classifications and use designations to a Community Mixed Use General (CM-G) zoning district classification and use designation; and WHEREAS, on May 21, 2008 and .tune 11, 2008, the Planning and Zoning Commission recommended approval of the requested change in zoning; and WHEREAS, the City Council finds that the change is consistent with the Denton Plan and the Development Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference as true. SECTION 2. The zoning district classification and use designation for the Property is hereby changed from Planned Development 139 (PD-139) and Neighborhood Residential Mixed Use (NRMU) zoning classifications and use designations to the Community Mixed Use General (CM-G) zoning classification and use designation, with an overlay further restricting allowed uses as set forth in Sections 3 and 4 of this ordinance. Notwithstanding the attached real property description, the Property being rezoned includes all property to the centerline of all adjacent street rights -of -way. SECTION 3. The following uses are prohibited in the overlay district: Dwellings Above Businesses, Live/Work Units, Community Homes for the Disabled, Multi -Family Dwellings, Hotels, Motels, Bed and Breakfast, Retail Sales and Services, Movie Theaters, Restaurant or Private Club, Drive-thru Facility, Quick Vehicle Servicing, Vehicle Repair, Auto and RV Sales, Laundry Facilities, Outdoor Recreation, Indoor Recreation, Major Event Entertainment, Commercial Parking Lots, Printing and Publishing, Bakeries, Kennels, Veterinary Clinics, Gas s:Aow documents\ordinancesV08\z08-0007 & z08-001 I of dinance.doc Wells, and Semi-public, Halls, Clubs and Lodges, as such terms are defined by the Denton Development Code. SECTION 4. Adult or Child Day Care uses, as defined by the Denton Development Code, are permitted with Specific Use Permit (SUP) approval on the Property. SECTION 5. The City's official land use map is amended to show the change in the land use designation. SECTION 6. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable. SECTION 7. Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION 8. This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage.
