HomeMy WebLinkAbout2007-160s:\our documents\ordinances\07\providence place abandonments ordinance.doc ORDINANCE NO. o?D0%-1UJ 0 AN ORDINANCE AUTHORIZING THE ABANDONMENT OF A 0.88 ACRE PUBLIC UTILITY EASEMENT TRACT RECORDED IN VOLUME 5322, PAGE 1096, OF THE REAL PROPERTY RECORDS OF DENTON COUNTY, TEXAS, THE ABANDONMENT OF A 0.183 ACRE PUBLIC DRAINAGE EASEMENT RECORDED IN VOLUME 5322, PAGE 1107, OF THE REAL PROPERTY RECORDS OF DENTON COUNTY, TEXAS AND THE ABANDONMENT OF A 1.077 ACRE PUBLIC DRAINAGE EASEMENT RECORDED IN VOLUME 5322, PAGE 1112 OF THE REAL PROPERTY RECORDS OF DENTON COUNTY, TEXAS SITUATED IN THE D. HOUGH SURVEY, ABSTRACT NO. 646; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Denton has received a request from the underlying fee simple owner, Quail Creek South L.P., for the abandonment of a 0.88 acre public utility easement tract. recorded in Volume 5322, Page 1096, of the Real Property Records of Denton County, Texas, the abandonment of a 0.183 acre public drainage easement recorded in Volume 5322, Page 1107, of the Real Property Records of Denton County, Texas and the abandonment of a 1.077 acre public drainage easement recorded in Volume 5322, Page 1112 of the Real Property Records of Denton County, Texas labeled as Tract 1, Tract 2 and Tract 3 respectively and being particularly described in Exhibit "A" and depicted in Exhibit "B" , attached hereto and made a part hereof by reference (the "Abandonment Areas"); and, WHEREAS, Quail Creek South L.P. has conveyed, by plat, being Amending Plat of Lot 1, Block D; Lot 1, Block E; Lot 1, Block F; and Lot 1, Block G of the Providence Place II (the "Amending Plat"), a 2.50 acre public utility and drainage easement and a 0.86 acre detention pond easement, both to the City of Denton, for the express purpose of accommodation for the public utilities and drainage therein; and, WHEREAS, staff has reviewed the requested abandonment of the Abandoned Areas and ' has recommended approval; and, WHEREAS, the City Council of the City of Denton hereby finds and determines that the Abandonment Areas are not needed for public 'utility nor public drainage purposes and it is in the public interest to abandon the Abandonment Areas and the City's public utility and drainage easement interests therein to the underlying fee owner, Quail Creek South L.P. ("Owner"); and, WHEREAS, notwithstanding any of the above, the City of Denton hereby retains all easement rights in all other easement tracts, whether conveyed by other instrument(s) or by plaits), in which the easement tracts described for abandonment herein cross and or overlap; ' NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, HEREBY ORDAINS: SECTION 1. The recitations and findings contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. Effective upon the recording of the Amending Plat in the Map and Plat Records of Denton County, Texas, the Abandonment Areas are permanently vacated, abandoned, and extinguished as public utility and drainage easements, except as provided herein. A certified copy of this ordinance may be recorded in the land records of Denton County to evidence the abandonment and the City Manager or his designee may execute other instruments to evidence this abandonment, that are consistent with this ordinance.
