AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING
ADDITIONAL EXPENDITURES OF $332,255.82 ASSOCIATED WITH THE
INTERLOCAL AGREEMENT BETWEEN THE CITY OF DENTON AND DENTON
INDEPENDENT SCHOOL DISTRICT FOR THE CONSTRUCTION OF AN
AQUATIC CENTER; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Denton and Denton Independent School District
("DISD") have entered into that certain Interlocal Agreement dated May 15, 2001
pertaining to the construction of an Aquatic Center consisting of a Natatorium and
Outdoor Aquatic Facilities (the "Interlocal Agreement"); and
WHEREAS, pursuant to the Interlocal Agreement DISD has entered into a
construction contract (the "Construction Contract") with Charter Builders (the
"Construction Manager"); and
WHEREAS, additional unforeseen expenditures to complete the Aquatic Center
have arisen for off -site utility construction, expenses exceeding the original estimate,
traffic control measures required by the Texas Department of Transportation, and an
alternate indoor slide, totaling $332,255.82 (the "Additional Expenditures"); and
WHEREAS, the City Council finds that the Additional Expenditures are in the
public interest; NOW, THEREFORE;
THE COUNCIL OF THE CITY OF DENTON, TEXAS HERBY ORDAINS:
SECTION 1. The findings contained in the preamble of this ordinance are
incorporated into the body of this Ordinance.
SECTION 2. The Additional Expenditures are hereby authorized. The City
Manager, or his designee, is authorized to execute any document on behalf of the City to
evidence this authorization, including any amendment to the hnterlocal Agreement, if
necessary.
SECTION 3. This ordinance shall become effective immediately upon its
passage and approval.
