ORDINANCE NO. O0p4 "DODO
AN ORDINANCE OF THE CITY OF DENTON AUTHORIZING AMENDMENT NO. 2 OF
AN AGREEMENT DATED AUGUST 15, 2000 RELATING TO A GRANT FOR ROUTINE
AIRPORT MAINTENANCE PROGRAM BETWEEN THE CITY OF DENTON AND THE
STATE OF TEXAS ACTING THROUGH THE TEXAS DEPARTMENT OF
TRANSPORTATION; AUTHORIZING THE CITY MANAGER TO EXPEND FUNDS
PROVIDED FOR IN THE AMENDMENT; AND DECLARING AN EFFECTIVE DATE
(TxDOT Project No.: 2002DNTON; AND TxDOT CSJ No.: M218DNTON).
WHEREAS, Pursuant to Ordinance No. 2000-258, the City of Denton and the State of
Texas acting through the Texas Department of Transportation ("TxDOT") entered into an
agreement .dated August 15, 2000 relating to a grant for routine maintenance program (the
"Maintenance Agreement'); and
WHEREAS, Pursuant to Ordinance No. 2001-155 the City and TxDOT entered into an
Amendment No. 1 to the Maintenance Agreement; and
WHEREAS, TxDOT has presented to the City an Amendment No. 2 to the Maintenance
Agreement, a copy of which is attached hereto and made a part hereof by reference
("Amendment"); and
WHEREAS, the City Council finds that the Amendment is in the public interest; NOW,
THEREFOR,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The City Manager of the City of Denton, or his designee, is hereby
authorized to execute the Amendment on behalf of the City of Denton.
SECTION 2. The City Manager is hereby authorized to expend such funds as are provided
for in the Maintenance Agreement as amended.
SECTION I- This ordinance shall become effective immediately upon its passage and
approval.

GRANT FOR ROUTINE AIRPORT MAINTENANCE PROGRAM
(Grant for State Assisted Airport Routine Maintenance)
Amendment No. 02
TxDOT Project No.: AM 2002DNTON

The City of Denton,. referred to as the "Sponsor", and the Texas Department of
Transportation, referred to as the "State," have entered into a Grant For Routine Airport
Maintenance Program, TxDOT CSJ Number MI18DNTON, executed by the Sponsor on April
17, 2001, and by the State on May 2, 2001, for the routine maintenance of the Denton Municipal
Airport.
It is in the mutual interest of the Sponsor and the State to amend the Grant at this time to
update the necessary maintenance items and extend the term of the grant for the new fiscal year.
The following amendment to the Grant shall become effective upon execution of this
Amendment by the Sponsor and the State.
State financial assistance granted will be used solely and exclusively for airport
maintenance and other incidental items as approved by the State. Actual work to be performed
under this agreement is found on Attachment A, Scope of Services. State financial assistance,
Amount B, will be for fifty percent (50%) of the eligible project costs for this project or
$30,000.00, which ever is less, per fiscal year and subject to availability of state appropriations.
Scope of Services, Attachment A, of this Grant, may be modified by letter from the
Sponsor with concurrence of the State if no additional funds are required.
The Grant is amended to include Attachment A - Scope of Services attached and made a
part of this agreement. Work shall be accomplished by August 31, 2002 unless otherwise
approved by the State.
All other terms and conditions of the agreement are unchanged and remain in full force
and effect.

City to do pavement maintenance by continuation of reconstruction of airport access roads: apron
and taxiway maintenance; fencing (improvements to sate operators) and maintenance of current
drainage system. State will reimburse the City 50% of actual contracted and materials costs. As
stated in Part II. Item. 5, of the original grant agreement - The State will not participate in
funding for force account work conducted by the Sponsor.
