HomeMy WebLinkAbout2001-003S \Our Documents\Ordinance8\01\FEMA COOP Ordinance doe ORDINANCE NO // 1— 0,0i3 AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DENTON AND THE FEDERAL EMERGENCY MANAGEMENT AGENCY, REGION VI ("FEMA"), TO PROVIDE FOR AN ALTERNATE CONTINUITY OF OPERATIONS FACILITY AT NORTH LAKES PARK AND RECREATION CENTER IN THE EVENT FEMA'S PERMANENT FACILITY IS UNAVAILABLE IN AN EMERGENCY, AUTHORIZING THE EXPENDITURE OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I The City Manager or his designee is hereby authorized to execute a Memorandum of Understanding between the City of Denton and the Federal Emergency Management Agency, Region VI ("FEMA"), to provide for an alternate continuity of operations facility at North Lakes Park and Recreation Center in the event that FEMA's permanent facility is unavailable in an emergency, a copy of which is attached hereto and made a part hereof SECTION 2 The City Manager or his designee is authorized to make the expenditures as set forth in the attached Memorandum of Understanding SECTION 3 This ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the o� ILY day of 2001 EULINE BROCK, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY .. �.1VED AS TO LEGAL MEMORANDUM OF UNDERSTANDING DENTON PARKS Federal Emergency Management Agency Region VI and City of Denton, Texas The following Memorandum of Understanding (the Agreement) sets forth the terms of agreement between the Federal Emergency Management Agency (FEMA) and the City of Denton, Texas, with regard to implementation of the FEMA Region VI Continuity of Operations (COOP) Plan L Purpose of Agreement The purpose of this Agreement is to establish responsibilities of the parties as they relate to a COOP situation, which would cause Region VI personnel to operate in an alternate facility II. Duration of Agreement The Agreement is effective upon signature of the FEMA Region VI Director and the Denton City Manager, and shall remain in effect until one, or both, parties cancel, in accordance with the terms set forth herein III. Program Description COOP is a program whereby the FEMA Region VI personnel must be capable of operating on a continual basis, even if the facility currently being occupied is uninhabitable In this instance, Region VI personnel would have to be available to provide direction and guidance to their representative states during emergency declarations To do so, an off -site facility must be made available to house emergency personnel, as prescribed in the Region VI COOP Plan IV. General ProVISIOns It is understood by both the Denton City Manager and the Region VI Director that each agency should be capable of fulfilling its responsibilities under this Agreement If at any time either party is unable to perform its functions under this Agreement, the affected party shall immediately provide notice to the other V. Responsibilldes of the Parties Under Agreement In consideration of the mutual covenants of the parties to this Agreement, the City of Denton, Texas and FEMA Region VI agree that their responsibilities under this agreement are as follows 1 A. City of Denton, Texas agrees (during an emegency when Region Vrs permanent facll/ty is unava//able due to the emegency) to: (1) Provide office space in an facility located at 2001 W Windsor, in the North Lakes Park and Recreation Center to Region VI personnel during COOP situations Minimum space shall include the game room and an accompanying office with 874 sq ft (the "Emergency Facilities") (2) Provide access to the aforementioned space as determined by the situation, which could involve after-hours and weekend hours of operation (3) Provide access entry keys or a facility manager to Region VI personnel, as determined by the situation (4) Provide telephone and computer connections, already in place, and allow access to Region VI personnel on a case -by -case reimbursable basis (5) Provide access to parking and restroom facilities (6) Provide access to tables and chairs for personnel as determined by the situation (7) Cease activities which would preclude access to the room or rooms being occupied 8 Region V/ agrees (during an emergency when Region VFs permanent facility Is unavailable due to the emergency) to: (1) Provide administrative supplies and equipment to conduct operations (2) Keep the Emergency Facilities in a neat and orderly fashion (3) Follow the City of Denton established rules for parking and facility entry (4) Not interfere in ongoing recreation center operations located in other parts of the facility Should additional requirements be necessary, Region VI agrees to coordinate with the Parks and Recreation Director, located within the City Emergency Operations Center (EOC) (5) Reimburse the City all costs associated with renting the Emergency Facilities NOTE. In any situation where the Emergency Facilities are being used by the city for emergency operations, the City EOC Director reserves the right to withdraw support to Region VI if space is not available VG Allocation of Costs A. The Emergency Facilities shall be made available free of charge for up to 72 hours, to include utilities Should other costs be incurred, such costs will be the full responsibility of the participants who mcur them B. An additional option is available to rent the entire facility, should the need arise In such an incident where the entire facility is needed, a rate of $500 00 per day, including staff, will be assessed Vll.
