ORDINANCE NO of 00/ 11A
AN ORDINANCE OF THE CITY OF DENTON, TEXAS TO PROVIDE FOR A ZONING
PLAN FOR 341 ACRES LOCATED WITHIN PLANNED DEVELOPMENT (PD-100) AND
SINGLE FAMILY (SF-7[c]35) ZONING DISTRICTS, TO AMEND PLANNED
DEVELOPMENT 100 (PD-100) DISTRICT TO ALLOW FOR SINGLE FAMILY USES, THE
SUBJECT PROPERTY BEING LOCATED NORTH OF ROBINSON ROAD, EAST OF
TEASLEY LANE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN
THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND
PROVIDING FOR AN EFFECTIVE DATE (ZP00-0008)
WHEREAS, on February 1, 2000, the City Council adopted Ordinance No 2000-046
which established certain residential interim regulations (the "Residential Intenm Regulations"),
WHEREAS, the Residential Intenm Regulations established, among other things, a
Zoning Plan requirement in the event of a request to rezone property, and
WHEREAS, on June 21, 2000, Lloyd Blaylock applied for a change in zoning for 34 1
acres of land located north of Robinson Road, east of Teasley Lane, amending Planned
Development (PD-100) and changing Single Family (SF-7[c]35) zoning district classifications
and land use designations to be included in Planned Development 100 (PD-100) zoning district
classification and land use designation with the intent to develop a single family subdivision with
open space which application includes a Zoning Plan, a copy of which is attached hereto as
Exhibit "B" (the Zoning Plan"), and
WHEREAS, on February 14, 2001, the Planning and Zoning Commission recommended
approval of the requested change in zoning and the Zoning Plan, and
WHEREAS, the City Council finds that the Zoning Plan, with the conditions imposed
herein, meets the requirements of the Residential Intenm Regulations and is consistent with the
approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 The zoning district classification and land use designation of the 34 1 acres
property described in the legal description attached hereto and incorporated herein as Exhibit A
is changed by amending Planned Development (PD-100) and changing Single Family (SF-
7[c]35) zoning district classifications and land use designations to be included in Planned
Development 100 (PD-100) zoning district classification and land use designation under the
comprehensive zoning ordinance of the City of Denton, Texas to allow a single family
subdivision with open space The Zoning Plan and said change in zoning are hereby approved
subject to the following conditions
The private park site shown on the Zoning Plan shall be deed restricted for use as a park
site with ownership thereof being vested in a home owners association ("HOA") The
park site shall be platted as a separate lot which shall be designated thereon as a private
park site The HOA documents shall contain a provision for adequate maintenance of the
park site winch provision shall not be amended, nor shall the HOA be dissolved, without
the prior written approval of the City of Denton The HOA documents and deed
restriction must be submitted to the City Attorney for review and approval prior to final
plat approval
SECTION 2 The City's official zoning map is amended to show the change in zoning
district classification
SECTION 3 If any provisions or the application thereof to any person or circumstance is
held invalid by any court, such invalidity shall not affect the validity of other provisions or
applications, and to this end the provisions of this ordinance are severable
SECTION 4 That any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense
SECTION 5 That this ordinance shall become effective fourteen (14) days from the date
of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to
be published twice in the Denton Record Chronicle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage pp

LEGAL DESCRIPTION
BEGINNING at a %2 inch iron rod found for the southeast comer of said Lot 2, Block N
and being in the West line Loop 288 (120 foot right-of-way) as dedicated by said
Oakmont Phase II - Section I addition,
THENCE North 86 degrees 33 minutes 17 seconds West, departing the West line of said
Loop 288 and with the South line of said Lot 2 for a distance of 100 02 feet to a''/2 inch
iron rod found for corner, said point being in the east line of said 29 188 acre tract,
THENCE South 02 degrees 22 minutes 09 seconds West for a distance of 6 79 feet to a 6
inch post found for the Southeast corner of said 29 188 acre tract and being the North line
of Robinson Road, a 60-foot wide undedicated public right of way,
THENCE North 86 degrees 29 minutes 39 seconds West along the North line of said
Robinson Road for a distance of 863 81 feet to a 6 inch steel fence corner found for the
Southwest corner of said 29 188 acre tract, same being the Southeast comer of Lakewood
Estates, an addition to the City of Denton, recorded in Cabinet C, Page 193, Plat Records
of Denton County, Texas,
THENCE North 02 degrees 19 minutes 52 seconds East, along the West line of said
29 188 acre tract, and along the East line of Lakewood Estates for a distance of 1422 40
feet to a %2 inch iron rod found for corner, said corner being on the South line of a tract of
land conveyed to the State of Texas by deed recorded in Volume 435, Page 12, Deed
Records of Denton County, Texas,
THENCE North 87 degrees 01 minutes 55 seconds East, with the North line of said
29 188 acre tract and the South line of said State of Texas tract, passing the Northwest
corner of said Lot 1, Block N at a distance of 868 35 feet and continuing for a total
distance of 1,192 52 feet to a'/2 inch iron rod found for corner in the West line of said
Loop 288 and being the beginning of a non -tangent curve to the left having a central
angle of 28 degrees 01 minutes 23 seconds, a radius of 1,900 00 feet and a chord bearing
and distance of South 16 degrees 22 minutes 50 seconds West, 920 04 feet,
THENCE in a Southerly direction with the West line of said Loop 288 and along said
curve for an arc distance of 929 28 feet to a''/2 inch iron rod found for corner,
THENCE South 02 degrees 22 minutes 09 seconds West, with the West line of said Loop
288 for a distance of 652 89 feet to the POINT OF BEGINNING, and containing
1,485,676 square feet or 34 106 acres of land

AN ORDINANCE OF THE CITY OF DENTON, TEXAS TO PROVIDE FOR A
PROJECT/DETAILED PLAN FOR 341 ACRES LOCATED WITHIN A PLANNED
DEVELOPMENT (PD-100) ZONING DISTRICT, THE SUBJECT PROPERTY BEING

WHEREAS, on February 1, 2000, the City Council adopted Ordinance No 2000-046
which established certain residential interim regulations (the "Residential Interim Regulations"),
WHEREAS, the Residential Interim Regulations established, among other things, a
Project Plan requirement, and

WHEREAS, on March 6, 2001, by Ordinance No2001-, t e City Council approved a
change inzoning and Zoning Plan for 34 1 acres of land, to be included in Planned Development
(PD-100) zoning district classification and land use designation, and
WHEREAS, on June 21, 2000, Lloyd Blaylock submitted a Project/Detailed Plan for 34 1
acres of land located within PD-100 with the intent to develop a single family subdivision with
open space, and
WHEREAS, on February 14, 2001, the Planning and Zoning Commission recommended
approval of a Project/Detailed Plan for such 34 1 acres, and
WHEREAS, the City Council finds that the Project/Detailed Plan is consistent with the
approved Zoning Plan, meets the requirements of the Residential Interim Regulations, and is
consistent with the approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

SECTION I Ordinance No providing for the approval of a Planned Development
Zoning District Classification and Use Designation for the property described as PD-100 is
amended by approving the Project/Detailed Plan attached hereto and incorporated herein by
reference as Exhibit B for 34 1 acres of land located within PD-100, more particularly described
by the legal description attached hereto and incorporated herein by reference as Exhibit A,
subject to the following conditions
The private park site shown on the Zoning Plan shall be deed restricted for use as a park
site with ownership thereof being vested in a home owners association ("HOA") The
park site shall be platted as a separate lot which shall be designated thereon as a private
park site The HOA documents shall contain a provision for adequate maintenance of the
park site which provision shall not be amended, nor shall the HOA be dissolved, without

the prior written approval of the City of Denton The HOA documents and deed
restriction must be submitted to the City Attorney for review and approval prior to final

SECTION 2 The provisions of this ordinance as they apply to the 34 1 acres shown in
the Project/Detailed Plan herein approved shall govern and control over any conflicting
provisions of Ordmance No 2001-112

SECTION 3 A copy of this ordinance shall be attached to Ordinance No showing
the amendment herein approved
SECTION 4 If any provisions or the application thereof to any person or circumstance is
