AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING THE CITY
ATTORNEY TO INTERVENE ON BEHALF OF THE CITY AS A PARTY IN TNRCC
DOCKET NO 2000-1412-AIR (MARTIN MARIETTA MATERIALS OF TEXAS, INC),
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the Council of the City of Denton, Texas expressed its opposition to an
asphalt/concrete plant planned as real property located within the City's extratemtonal
jurisdiction, near the Denton City limits, situated on Masch Branch Road and the Air Quality
Permit #39266, and executed Resolution No R98-064 on the P day of November, 1998, and
WHEREAS, on the 6i" day of February, 2001 the Council of the City of Denton, Texas
again expressed its opposition to the same asphalt/concrete plant and Air Quality Permit, with all
seven members of the Council executing Resolution No R2001- 003, and
WHEREAS, the City Council believes that the impact of the plant will detrimentally
affect neighborhoods near the proposed location of the plant and for other reasons, and deems it
in the public interest to intervene as a party in TNRCC Docket No 2000-1412-AIR, and
WHEREAS, the City Council hereby instructs the City Attorney to intervene as a party to
oppose the Air Quality Permit in the above numbered and entitled cause, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the City's attorneys (including any outside legal counsel the City
Council may hire) are hereby authorized to intervene as a party in, and otherwise participate in
TNRCC Docket No 2000-1412-AIR, concerning Martin Marietta Materials of Texas, Inc to
oppose the Air Quality Permit, and to take all other actions necessary or appropriate to resolve
all issues in the case
SECTION 2 That this ordinance shall become effective immediately upon its passage
and approval PASSED AND APPROVED this the 6-h day of 2001
