ORDINANCE NO 0 PPl - ��� AN ORDINANCE OF THE CITY OF DENTON, TEXAS TO PROVIDE FOR A ZONING PLAN FOR APPROXIMATELY 24 ACRES LOCATED WITHIN A SINGLE FAMILY (SF-7) ZONING DISTRICT, TO CHANGE TO A PLANNED DEVELOPMENT (PD) DISTRICT TO ALLOW FOR MULTI -FAMILY USES, THE SUBJECT PROPERTY BEING LOCATED BETWEEN UNIVERSITY DRIVE AND MINGO ROAD, APPROXIMATELY 500' EAST OF RUDDELL STREET, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (ZP-01-0001) WHEREAS, on February 1, 2000, the City Council adopted Ordinance No 2000-046 which established certain residential interim regulations (the "Residential Interim Regulations"), WHEREAS, the Residential Interim Regulations established, among other things, a Zoning Plan requirement in the event of a request to rezone property, and WHEREAS, on January 22, 2001, SENT Corporation, on behalf of Southwest Housing Development, applied for a change in zoning for 22 7 acres of land located between University Drive and Mingo Road, approximately 500' east of Ruddell Drive, from a Single Family (SF-7) zoning district classification and land use designation to Planned Development (PD) zoning district classification and land use designation with the intent to develop a senior housing mult- family complex with a community center which application includes a Zoning Plan, a copy of which is attached hereto as Exhibit "B" (the Zoning Plan"), and WHEREAS, on March 14, 2001, the Planning and Zoning Commission recommended approval of the requested change in zoning and the Zoning Plan, and WHEREAS, the City Council finds that the Zoning Plan, with the conditions imposed herein, meets the requirements of the Residential Interim Regulations and is consistent with the approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The zoning district classification and land use designation of the approximately 24 acres property described in the legal description attached hereto and incorporated herein as Exhibit A (the "Property") is changed from Single Family (SF-7) zoning district classification and land use designation to Planned Development (PD) zoning district classification and land use designation under the comprehensive zoning ordinance of the City of Denton, Texas to allow a senior housing complex with a community center in accordance with the Zoning Plan The Zoning Plan and said change in zoning are hereby approved, subject to the following, conditions 1 All lighting from the development will not be allowed to reflect upward into the night sky S \Our Documents\0rdinances\01\ZP 01 0001 doc A community center, not to exceed 6,000 square feet, is added to the allowed uses A solid screening fence of wood panels with metal posts shall be added to the entire western property line The monument signs shall be placed a minimum of 10' from respective property lines Parking for the park site shall be internal to the park and no parking for the park site shall be allowed on or adjacent to the cul de sacs in the adjacent single family residential subdivision The existing fence along the east side of the Property shall either remain or be replaced by a fence that is equivalent to or better than the existing fence Park development and access to the park from the east will be coordinated with residents of the single family subdivision adjacent to the Property SECTION 2 The City's official zoning map is amended to show the change in zoning district classification SECTION 3 If any provisions or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable SECTION 4 Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 5 This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record Chronicle, official newspaper of the City of Denton, Texas, within
