AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ORDINANCE NO 99-
265, TO CHANGE THE PERMITTED LAND USES FOR THE PLANNED DEVELOPMENT
173 (PD-173) ZONING DISTRICT AND LAND USE CLASSIFICATION TO ALLOW THE
DRILLING, COMPLETING, OPERATING, REWORKING, RECOMPLETING AND
PRODUCING OF NATURAL GAS AND TO AMEND THE LANDSCAPING
REQUIREMENTS FOR THE DEVELOPMENT, SAID PD-173 CONTAINS
APPROXIMATELY 2,275 ACRES AND IS COMMONLY KNOW AS ROBSON RANCH,
PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z-01-0007)
WHEREAS, on August 3, 1999, by Ordinance 99-265, the City Council approved a
Concept Plan for approximately 2,275 acres located in the Planned Development 173 (PD-173)
Zoning District, as more particularly described therein, and
WHEREAS, geo-technical surveying has indicated that it is likely that deposits of natural
gas exist beneath said 2,275 acres, and
WHEREAS, on April 23, 2001, Carter and Burgess, on behalf of Robson Denton
Development LLC, submitted a request to amend the Concept Plan for PD-173 to permit
activities iassociated with the drilling for and extraction of natural gas and to revise the landscape
requirements for the district, and
WHEREAS, on June 13, 2001, the Planning and Zoning Commission recommended
approval of the amended Concept Plan and zoning change, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SSACTION 1 Ordinance No 99-265, providing for the approval of a Concept Plan for the
Planned Development 173 (PD-173) Zoning District Classification and Use Designation, is
hereby amended by approving the amended concept plan and documentation attached hereto and
incorporated herein by reference as Exhibit A for the entire Planned Development 173 (PD-173)
Zoning District Classification and Use Designation to allow for the drilling, completing,
operating, reworking, recompletmg, and producing of natural gas, subject to the following
conditions
1 Lighting on the property shall be designed and maintained so as not to shine on or
otherwise disturb surrounding residential propetrty or to shine and project upward to
prevent the diffusion into the night sky
2 Trees planted in the Outdoor Recreation, Parking, Gas Parks and street/right-of-way
land use areas will count towards the tree -planting requirements of the Residential,
Neighborhood Services and Community Service land use areas
3 All conditions and requirements in Exhibit A
SE TION 2 The provisions of this ordinance as they apply to the amendments herein
approved, shall govern and control over any conflicting provisions of Ordinance No 99-265, but
all the provisions of Ordinance No 99-265 as it applies to the regulations of the district not
herein amended, shall continue in force and effect and shall apply to the remainder of said
district
SECTION 3 A copy of this ordinance shall be attached to Ordinance No 99-265
showing the amendment herein approved
SECTION 4 Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense
S CIF TION 5 This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published' twice in the Denton Record Chronicle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
