HomeMy WebLinkAbout2001-262ORDINANCE NO (59001-0 1W AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE PERMIT FOR A MOBILE HOME COMMUNITY ON APPROXIMATELY 23 7 ACRES OF LAND LOCATED AT THE NORTHWEST CORNER OF FORT WORTH DRIVE AND MISSION STREET, WITHIN A LIGHT INDUSTRIAL (LI) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-01-0016) WHEREAS, the City of Denton, on behalf of Rene Cassar, has applied for a specific use permit for an existing mobile home park on 23 7 acres of land located at the northwest corner of Fort Worth Drive and Mission Street, within a Light Industrial (LI) zoning district classification and use designation, and WHEREAS, on June 27, 2001, the Planning and Zoning Commission recommended approval of a Specific Use Permit for a mobile home park, and WHEREAS, the City Council finds that the Specific Use Permit is consistent with The Denton Plan, and WHEREAS, in accordance with Article 11I, Division 4, of Chapter 35 of the Code of Ordinances of the City of Denton, Texas, the City Council finds that all of the following conditions exist The specific use will be compatible with and not injurious to the use and enjoyment of other property nor significantly dimimsh or impair property values within the immediate vicinity, The establishment of the specific use, a mobile home park, will not impede the normal and orderly development and improvement of surrounding vacant property, Adequate utilities, access roads, drainage, and other necessary supporting facilities have been or will be provided, The design, location, and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments, Adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise, and vibration, Directional lighting will be provided so as not to disturb or adversely affect neighboring properties, PAGE 1 There is sufficient landscaping and screening to ensure harmony and compatibility with adjacent property, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I A specific use permit is hereby granted to allow a mobile home park on approximately 23 7 acres of land, consisting of an approximate 21 270 acre tract of land legally described as Tract 58 of the W Daniel Survey, Abstract No 378, and more fully described in that certain warranty recorded under Denton Country Clerk Number 94-0005624 in the Deed Records of Denton County, and an approximate 0 7089 acre tract of land legally described as Tract 59 of the W Daniel Survey, Abstract No 387, and more fully described in that certain warranty deed recorded under Denton County Clerk Number 94-0005624 in the Deed Records of Denton County, and an approximate 173 acre tract of land legally described as Tract 61 of the W Damel Survey, Abstract No 387, and more fully described in that certain instrument recorded in Vol 1164, Page 794 of the Deed Records of Denton County Said 23 7 acre tract is located at the northwest corner of Fort Worth drive and Mission Street, within a Light Industrial (LI) zoning district classification and use designation The specific use permit and the site plan attached hereto and incorporated herein as Exhibit "A," are hereby approved subject to the following conditions The specific use permit will be tied to the site plan shown as Exhibit "A" with the following modifications lots 16, 26, 32,51 and 57 have been eliminated or combined to increase adjacent lot sizes, and the total number of lots allowed by this Specific Use Permit is 169 New lighting on the property shall be designed and maintained so as not to shine on or otherwise disturb surrounding residential property or to shine and project upward to prevent the diffusion into the night sky SECTION 2 The City's official zoning map is amended to show the change in zoning district classification SECTION 3 Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SSECTION 4 This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chromcle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the&L,�tday of 2001 C�'v 0CL EULINE
