HomeMy WebLinkAbout2001-266S Wu pocummuWNlnepcMAlWnmdmm, i 5711Ermy non rm1dmi fin doo AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN AMENDMENT TO CHAPTER 2, ARTICLE V LIBRARY, SECTION 2 157 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, TO ELIMINATE THE PAYMENT OF AN ANNUAL FEE FOR NONRESIDENTS FOR A LIBRARY CARD, PROVIDING A SEVERABILITY CLAUSE, PROVIDING FOR A SAVING CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, it is a condition of the Texas State Library and Archives Commission that in order to receive state aid that a library must eliminate existing fees levied against non-residents for services, and WHEREAS, it is recommended by the Library Board that the non-resident annual fee for a library card be eliminated, and WHEREAS, the City Council finds that it is in the public interest to eliminate the non- resident annual fee for a library card in order to receive state funding, NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 Chapter 2, Article V Library, Section 2-157 of the Code of Ordinances of the City is hereby amended in its entirety to read as follows Sec 2.157. Library cards An adult applicant is eligible for a library card free of charge upon making proper application regardless of residency SECTION 2 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable SECTION 3 That all provisions of the ordinances of the City of Denton in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Denton, not in conflict with the provisions of this ordinance, shall remain in fall force and effect SECTION 4 This ordinance shall become effective immediately from and after its adoption and passage PASSED AND APPROVED this the "I day of alom 2001 Page 1 of 1 swu.
