AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE
PERMIT FOR THE DRILLING, INSTALLATION AND THE OPERATION OF WELLS FOR
THE EXTRACTION OF NATURAL GAS ON APPROXIMATELY 239 ACRES OF LAND
GENERALLY LOCATED SOUTH OF HIGHWAY 380, EAST OF S NAIL ROAD AND NORTH
OF JIM CHRISTAL ROAD, WITHIN AN AGRICULTURAL (A) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR
AN EFFECTIVE DATE (Z-01-0025)
WHEREAS, AGF Ranch, has applied for a specific use permit for the drilling, installation
and the operation of wells for the extraction of natural gas on approximately 239 acres of land
generally located south of Highway 380, east of S Nail Road and north of Jim Chnstal Road, within
an agricultural (A) zoning district classification and use designation, and
WHEREAS, on August 8, 2001, the Planning and Zoning Commission recommended
approval of a Specific Use Permit for the drilling, installation and the operation of wells for the
extraction of natural gas, and
WHEREAS, the City Council finds that the Specific Use Permit is consistent with the Denton
Plan Policies, and
WHEREAS, in accordance with Article III, Division 4, of Chapter 35 of the Code of
Ordinances of the City of Denton, Texas, the City Council finds that all of the following conditions
exist
The drilling, installation and the operation of wells for extraction of natural gas will
be compatible with and not injurious to the use and enjoyment of other property nor
will it significantly diminish or impair property values within the immediate vicinity,
The establishment of the drilling, installation and operation of wells for the extraction
of natural gas will not impede the normal and orderly development and improvement
of surrounding property,
Adequate utilities, access roads, drainage, and other necessary supporting facilities
have been or will be provided,
The design, location, and arrangement of all driveways and parking spaces provides
for the safe and convenient movement of vehicular and pedestrian traffic without
adversely affecting the general public or adjacent developments,
Adequate nuisance prevention measures have been or will be taken to prevent or
control offensive odor, fumes, dust, noise, and vibration,

Directional lighting will be provided so as not to disturb or adversely affect
neighboring properties, and
There is sufficient landscaping and screening to ensure harmony and compatibility
with adjacent property,
NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY
ORDAINS
SECTION 1 A specific use permit is hereby approved for the drilling, installation and
operation of wells for the extraction of natural gas on approximately 239 acres of land described in
the development plat attached hereto and incorporated herein as Exhibit "A" and generally located
south of Highway 380, east of S Nail Road and north of Jim Chnstal Road, within an Agricultural
(A) zoning district classification and use designation, subject to the following conditions
1 Noise reduction measures shall be utilized to minimize the impact to adjacent single-family
properties
2 Dust prevention measures shall be utilized to minimize the impact to adjacent single-family
properties
3 Directional lighting, directed away from adjacent single-family residences shall be utilized
4 No well shall be located closer than five hundred (500') feet from an adjacent existing
residence
5 The drilling, installation and operation of wells shall comply with the requirements and
conditions of the Development Plat submitted with this proposal
6 All drilling permits required by the Fire Code shall be obtained
7 A road maintenance agreement shall be executed with the City of Denton
SECTION 2 The City's official zoning map is amended to show the change in zoning
district classification
SECTION 3 Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense
SECTION 4 This ordinance shall become effective fourteen (14) days from the date of its
passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage

DEVELOPMENT PHASING

WATER CONSUMPTION
Once well permits have ben obtained from - the Texas Railroad Commission and made have been extended to the well locutions, drilling an commence
The drilling of each well will require approximately 8000 barrels of water over a two to three week period This water, If available and With the permisslor
of the surfaos owner, will be pumped from a nearby pond or stream to minimize the amount of Wcidng required
Once a well has been drilled and determined to have the potenflal for commercial production, the completion p=m will begin In order for the Barnett
Shale to be commercially productive it must be fracture stimulated. This Imrolves pumping a large amount of water at high pressure Into the formation
to create a fracture in the rock A small amount of sand Is mixed with the water to hold the fracture open axe the procedure Is completed This pens
the gas to flaw more easily from the rock Into the wellbors. Each fracture stimulation requires approximately 25,000 barrels of water This water will b
trucked to the location in a period of about two days and stored In portable tanks Once the water Is In place, the actual stimulation process will take
approximatey, eight hours. This process may be repeated once every five to to years depending on the productivity of the well
WASTE CONTROL
Water and drilling mud utilized during the drilling of the well will be Initially stored In a reserve pit located adjacent to the well Ultimately, the water
and drilling mud will be removed by truck and disposed of In accordance with the requirements of the Texas Railroad Commisskn. The reserve pit
Will be dewatered whhln approxlmataiy SO days and beeknifed within 120 days (subject to weather) of the completion of the wag In compliance with
the requirements of the Texas Railroad Commission
Wastewater and condensate from gas production will be stored In a 300 barrel tank within the well site location. The tank will be located within a
secondary, cgtdolnment dng with a non-permf able liner capable of holding one and one-half times the capacity of the tank The tank will also be
equipped with a sensing device that Will shut oil the wall(s) should the tank become fug The contents of the tank will be emptied by a commercial
operator and disposed of In accordance with the requirements of the Texas Railroad Commission
DRAINAGE
No meters, storage tanks, separation facilities, or other aboveground facilities shall be place In the 100-year floodplain
A separate and more debited site drainage plan shall be submitted for each well site krattn The drainage plan shall Include the wellslts location
and any accessory structures that service the drilling or production of gas The 100-year floodplain shall also be shown on the drainage plan as well as

ENVIRONMENTAL IMPACTS
The proposed gas development will be in compliance with all state and federal environmental regulations and will not edversey affect the floodpiain,
