HomeMy WebLinkAbout2001-343ORDINANCE NO M0 —J�f AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING CHANGE 'FROM MULTI-FAMILY-1 (MF-1) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION ALLOWING RESIDENTIAL AND JEWERLY/HANDCRAFTS SHOP USES FOR APPROXIMATELY 0 2 ACRES OF LAND COMMONLY KNOWN AS 315 WEST SYCAMORE STREET GENERALLY LOCATED 350 FEET EAST OF THE INTERSECTION OF CARROLL BOULEVARD AND SYCAMORE STREET LEGALLY DESCRIBED AS PART OF LOT 3 AND ALL OF LOT 4 OF THE STROUD ADDITION, PROVIDING A CONCEPT PLAN, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-01-0024) WHEREAS, Angela J Sangmu initiated a change in zoning for approximately 0 2 acres of land from Multi-family-1 (MF-1) zoning distract classification and use designation to Planned Development (PD) zoning district classification and use designation allowing residential and jewelry/handcrafts shop uses, and WHEREAS, on August 8, 2001, the Planning and Zoning Commission concluded a public hearing as required by law, and recommend approval of the requested change in zoning, and WHEREAS, the City Council finds that the change in zoning is consistent with the Comprehensive Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The zoning distract classification and use designation of the approximately 0 2 acres described in the legal description attached hereto and incorporated herein as Exhibit A is changed from Multi-family-1 (MF-1) zoning district classification and use designation to Planned Development (PD) zoning district classification and use designation allowing one single-family residential dwelling and jewelry/handcrafts shop uses and the Detailed Plan attached hereto and incorporated herein as Exhibit B is hereby approved, subject to the following condition Any proposed signage shall be compatible with the scale and architectural character of the existing structure SECTION 2 The City's official zoning map is amended to show the change in zoning district classification SECTION 3 If any provision of this ordinance or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable Page 1 of 2 SECTION 4 Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 5 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published m the City of Denton, Texas, within ten (10) days of the date of its passage / PASSED AND APPROVED this the , 6 day of - jgdolelqi 2001 ATTEST JENNIFER WALTERS, CITY SECRETARY BY tUV,I C.l ,aJ APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY F" EULINE BROCK, MAYOR Page 2 of 2 Exhibit A BEING all that certain lot, tract or parcel of land situated In the W.
