HomeMy WebLinkAbout2000-094P WweCWgxLLOL`9urOmmmle�OrA�moe�meEmEomvnrafuulny eeeemmRl Goe ORDINANCE NO �?00'0 AN ORDINANCE PARTIALLY VACATING A UTILITY EASEMENT ESTABLISHED BY JUDGMENTS RECORDED IN VOLUME 588, PAGE 457, VOLUME 588, PAGE 459, AND VOLUME 2259, PAGE 544 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, AS IT PERTAINS TO LOT 1, BLOCK 1 OF THE TEXAS INSTRUMENTS ADDITION, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton has received a request for the abandonment of a portion of a certain utility easement, and WHEREAS, the Development Review Committee of the City of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the Council of the City of Denton, Texas has determined that the utility easement being vacated is no longer needed for public use since the applicant has dedicated other casements to facilitate the installation of utilities in the Texas Instruments Addition, and WHEREAS, the fair market value of the utility easement has been determined and received, as required by section 272 001 of the Texas Local Government Code, NOW THERFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 A portion of the 30-foot wide utility easement established by Judgments recorded in volume 588 page 457, Volume 588, Page 459 and Volume 2259, Page 544 of the Deed Records of Denton County Texas as it affects Lot 1, Block I of the Texas Instruments Addition, an addition to the City of Denton, Texas according to the plat thereof recorded in cabinet G, page 48 of the Plat Records of Denton County, Texas as more particularly described and illustrated in Exhibit A, attached hereto and incorporated herein by reference, is permanently vacated and extinguished as a public easement, to the extent described in said exhibit SECTION 2 By reason of such vacation the City of Denton's property interest in the easement shall, by operation of law, revert to the owner or owners abutting the easement herein abandoned, and the City of Denton releases any and all claims to the use of the vacated property as a public easement SSECTION 3 This ordinance shall become effective immediately upon its passage and approval �/ PASSED AND APPROVED this the / 0day of � , 2000 vv H"EMDEm Lww orounir MwMnm WFLER, MAYOR ATTEST' JENNIFER WALTERS, CITY SECRETARY BY APP OVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY 110 Page 2 "EXHIBIT A" ALL that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, in the J S. Collard Survey, Abstract Number 297 and being part of those electric distribution line easements conveyed to the City of Denton by documents recorded in Volume 588, Page 457, Deed Records of Denton County, Texas (Webster tract), and in Volume 588, Page 459, D.R.D.C.T. (Cole tract), and in Volume 2259, Page 544 of the Real Property Records of Denton County, Texas (Cole tract re -filed), and a Judgement for an electric easement to the City of Denton styled as Cause Number 6031 and filed on December 2,1968 in the County Court of Denton County, Texas (Hall tract), all as they affect Lot 1, Block 1, Texas Instruments Addition, an addition to the City of Denton, recorded in Cabinet G, Page 48 of the Plat Records of Denton County, Texas.
