AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR AN
EMERGENCY PURCHASE OF TESTING FOR INFESTATION OF FUNGI AT
CENTRAL FIRE STATION IN ACCORDANCE WITH PROVISIONS OF STATE
LAW EXEMPTING SUCH PURCHASES FROM REQUIREMENTS OF
COMPETITIVE BIDDING, AND PROVIDING AN EFFECTIVE DATE (PURCHASE
ORDER 04125 TO THE PROVIDENT GROUP IN THE AMOUNT OF $7,250 PLUS
CHANGE ORDER I IN THE AMOUNT OF $19,400 FOR A TOTAL OF $26,650)
WHEREAS, state law and ordinance require that certain contracts requiring an
expenditure or payment by the City in an amount exceeding $15,000 be by competitive bids,
except in the case of public calamity where it becomes necessary to act at once to appropriate
money to relieve the necessity of the citizens of the city, or in case of unforeseen damage to
public property, machinery or equipment, and,
WHEREAS, the City Manager has recommended to the City Council that it is necessary
to purchase goods or services due to the following emergency conditions outlined in the
memorandum attached hereto, incorporated herein by reference, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the City Council hereby determines that there is a public calamity
that makes It necessary to act at once to appropriate money to relieve the necessity of the citizens
of the city, or to provide for unforeseen damage to public property, machinery or equipment, and
by reason thereof, the following emergency purchases of materials, equipment, supplies or
services, as described in the "Purchase Orders" referenced herein, are hereby approved

SECTION II That because of such emergency, the City Manager or designated
employee is hereby authorized to purchase the materials, equipment, supplies or services as
described in the attached Purchase Orders and to make payment therefore in the amounts therein

such purchases by the City from the requirements of competitive bids
SECTION III This ordinance shall become effective immediately upon its passage and

Subject: Proposal - Professional Services; Central Fire Station - Extensive evaluation

THE PROVIDENT GROUP is pleased to have the opportunity to submit this proposal to conduct
the following activities at the Central Fun Station Tlus ucxt phase of cvaluahuli will invulvc
assessing the extent of infestation of Stachybottys (turd other) fungi in the building and on its various
internal surfaces This evaluation will require "destructive" sampling (actually investigating inside
walls, under floor coverings, etc )
Scope:
1 Conduct a thorough visual inspection of all areas in and under the building
2 Remove sections (IxI toot square) of each of the walls in the living quarters and the old
office area and collect samples
3 if visible evidence of mold is apparent, remove larger areas to aid in assessing further the
extent of infestation and the possible cause
4 Investigate and sample any areas with visible signs of water damage including baseboards,
erawispaees, above ceilings, and under carpets
5 Thoroughly evaluate entire I4VAC system removing appropriate sections to collect surface
samples
6 All activities urside ilia smpei,t areas will be wudw,icd in full protmtive Oudung ire lading,
approporiate respirator, Tyvek suits, ribber boots and gloves Until cleared, no personnel will
be allowed in these areas without the prescribed protective equipment
7 During the investigation of the crawl spaces, requirements for confined space entry will be
utilized and enforced
8 All samples will be handled, boxed, labeled and shipped properly and in accordance with
all DOT requirements
9 Every precaution will be taken to avoid any potential contamination of other areas or the
environnicnt
Assistance Needed From the Fire Department:
when entry into the crawl spaces is conducted, the electrical power in the building shall be
locked out and tagged to avoid dangers to electrical hazards in the moist/wet environment
under the building It possible an electric generator (perhaps from or on the tire trucks) is
needed

entry the atmosphere shall be appropriately tested, however, during confined apace entry in
the crawl spaces an appropriately trained fire-fighter with emergency rescue equipment is
needed (this was provided during the initial evaluation) This person will be stationed
immediately outside the containment area to avoid any unnecessary exposure to City
personnel Even with the remote need of eriuy, he/she will be prepared with the proper level
of personal protective equipment and SCBA
Only properly trained and experience personnel will be used All activities will be conducted under
the direction of a Board Certified Safety Professional (CSP), Registered Environmental Manager
(REM), and Board Certified Industrial Hygienist As the process proceeds, findings and status of
the prny-o will he communicated to City officials on a daily basis
Fees:
• Trained percormel (2-3) for approximately a week
• All required equipment except as needed from the Fire Department
All personal piotu,uvr eilurprrlelit and thspusables
• All analybeal/laboratory services
• Transportation and handling of samples to lab
• Evaluation of raw data
• Develop of draft and final reports
• Communication of results to staff and other personnel as needed

2 THE PROVIDENT GROUP will double•bagtdrum waste materials and make
rec nmmendations relative to proper disposal The proposed fees do not include expense for
drums, bags, or final disposition and disposal of any generated wastes
