HomeMy WebLinkAbout2000-182oo��mua ORDINANCE NO OOO--d'�' AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING AN ALTERNATIVE LANDSCAPE PLAN FOR A 0 6 ACRE OF LAND LOCATED AT THE SOUTHEAST CORNER OF INTERSTATE 35E AND TEASLEY LANE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING AN EFFECTIVE DATE (ALP-00-001) WHEREAS, Surveyors and Engineers of North Texas, Inc, on behalf of Douglass Development, has submitted an Alternative Landscape Plan for a 0 6 acre parcel at the southeast corner of Interstate 35E and Teasley Lane, and WHEREAS, Section 31-9 (2) (b) of the Landscape Ordinance, Chapter 31 of City Code, permits any property owner or developer to submit an Alternative Landscape Plan for City Council review and approval that fails to meet the requirements of the Landscape Ordinance but satisfies the spirit and intent of this article, and WHEREAS, on April 26, 2000, the Planning and Zoning Commission reviewed the aforementioned Alternative Landscape Plan and submitted an advisory opinion to City Council recommending its approval, and WHEREAS, the City Council finds that the aforementioned Alternative Landscape Plan meets the spirit and intent of the Landscape Ordinance, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The Alternative Landscape Plan attached hereto and incorporated herein as Exhibit A is approved for the 0 6-acre property located at the southeast corner of Interstate 35E and Teasley Lane, subject to the following conditions The applicant shall consider an alternative plant palette which seeks to find species best suited to withstand the harsh environment of the property Approval of final species list will be by building inspections department at time of issuance of building permit E TI 2 Any person violating any provision of this ordtnance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense 5ECTION3 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage Page 1 of 2 mamma 2000 PASSED AND APPROVED this the l day of aiROCK, MAYOR ATTEST S.
