ORDINANCE NO AWR ,5;
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FROM ONE -FAMILY DWELLING (SF-7) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION TO OFFICE WITH CONDITIONS (O[C]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR APPROXIMATELY 2 4 ACRES OF LAND
LOCATED ON THE SOUTH SIDE OF EAST UNIVERSITY DRIVE APPROXIMATELY 250
FEET WEST OF ITS INTERSECTION WITH REDWOOD DRIVE, PROVIDING FOR THE
APPROVAL OF A ZONING PLAN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN
THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (ZP-00-007)
WHEREAS, on March 2, 2000, the City Council adopted Ordinance No 2000-069 which
established certain nonresidential interim regulations (the "Nonresidential Intenm Regulations"),
WHEREAS, the Nonresidential Intenm Regulations established, among other things, a
Zoning Plan requirement in the event of a request to rezone property, and
WHEREAS, Roble McCarty, on behalf of Dr Stanley Evans, has applied for a change in
zoning for 2 4 acres of land located on the south side of East University Drive approximately 250
feet west of its intersection with Redwood Drive, from One -Family Dwelling (SF-7) zoning district
classification and land use designation to Office Conditioned (O[c]) zoning district classification and
use designation to allow the construction of a doctor's office and has submitted for approval a
Zoning Plan for this property under the Nonresidential Interim Regulations, a copy of which is
attached hereto as Exhibit "B", and
WHEREAS, on July 12, 2000, the Planning and Zoning Commission recommended approval
of the requested change in zoning and the submitted Zoning Plan, and
WHEREAS, the City Council finds that the Zoning Plan, with the conditions imposed herein,
meets the requirements of the Nonresidential Interim Regulations and is consistent with the approved
1999-2020 Denton Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
S) CTION 1 The zoning district classification and use designation of the 2 47 acre property
described in the legal description attached hereto and incorporated herein as Exhibit A is changed
from One Family Dwelling (SF-7) zoning district classification and use designation to Office
Conditioned (O[c]) zoning district classification and use designation under the comprehensive
zoning ordinance of the City of Denton, Texas and a Zoning Plan for the 2 47 acres is adopted, said
Zoning Plan being attached hereto and incorporated herein as Exhibit B for all purposes, with both
zoning and zoning plan being subject to the following conditions
The floor area of the main structure shall be limited to 10,000 square feet
2 A parapet shall be extended around the entire rooflme of the main structure
3 The main structure shall be limited to one story in height

8 foot high fencing shall be installed around the southern and eastern perimeter of the
property which shall be supported by steel or masonry posts The fence shall be
approximately 10 feet inside the southern and eastern property lines
5 Hours of operation shall be such that clients will not be admitted before 8 00 a in or after
800pm
6 There shall be a 20 foot buffer yard along the southern and eastern boundaries of the property
that shall be maintained in its natural state with limited maintenance, except for the area
needed for drainage detention
7 Headlights shall be screened so as not to shine into surrounding residential property
Lighting on the property shall be designed and maintained so as not to shine on or otherwise
disturb surrounding residential property or to shine and project upward to prevent the
diffusion into the night sky
Uses shall be limited to professional office uses Professional office uses are defined as
offices for accounting, architecture, landscape architecture, land surveying, medicine, dental,
optometry, engineering, real estate appraising, nursing, or law practice
SECTION 2 The City's official zoning map is amended to show the change in zoning
district classification
SECTION 3 If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable
SECTION 4 Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense
SECTIONS That this ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chromcle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage

All that certain tract of land situated in the J. D Lilly Survey, Abstract No 762, City of
Denton, Denton County, Texas and being a part of the called 12 0 acre tract described in
the deed from Del Holmes et ux to C E Curry et ur recorded in Volume 345, Page 213,
Deed Records, Denton County, Texas and being more particularly described by metes
and bounds as follows
BEGINNING for jhe Northeast comer of the herein described tract at the Northwest
comer of Lot 1, Block I of the Sequoia Park Subdivision as recorded in Volume 413,
Page 409 of the said Deed Records on the South right-of-way line of Highway No 390
(E Ubiversity Drive) at it's intersection with the East line of the 12 0 acre tract,
THENCE South 00 dooms 26 minutes 09 seconds West with the East line of the said
12.0 acre tract and the West line of the said Sequoia Park Subdivision a distance of
264 34 feet to the Southeast comer of the said 12 0 acre tract,
THENCE South 89 degrees 56 minutes 03 seconds West with the South line of the said
12 0 acre tract the North line of the said Sequoia Park Subdivision and the North line of
the called 29167 acre tract described in the Deed from Dan Trammel to Mobility
Systems, Inc recorded in Volume 2650. Page 956 of the said deed records a distance of
786 lb feet to the East nght-of-way line of the said State highway No 390,
THENCE North 70 degrees 42 minutes 16 seconds East with the Southeast ngbt-of-way
line of highway 380 a distance of 733 27 feet to an angle point therein,
THENCE North 76 degrees 34 minutes 08 seconds East continuing with the South right-
of-way line of Highway 380 a distance of 98 73 feet to the PLACE OF BEGINNING
enclosing 2 47 acres of land
